At the Commission’s October 17, 2023, Decision Meeting, Staff recommended the Commission process the Tariff Advice as a formal case to allow for formal participation by interested parties. On October 23, 2023, the Commission converted the Tariff Advice to a formal case, issued a Notice of Application, and set a deadline for interested parties to intervene. Order No. 35967. No one petitioned to intervene. Staff filed comments to which the Company replied. No other comments were received. On December 27, 2023, the Commission issued Order No. 36039 directing the Company to require all customers that request service exceeding 25,000 kVAs to take service at transmission- voltage and under the appropriate schedule(s). In addition, the Company was ordered to file updated tariffs as a compliance filing within 21 days. On January 4, 2024, the Company submitted a compliance filing with updates to the tariffs proposed in the original filing that will require all customers who request service exceeding 25,000 kVAs to take service at transmission-voltage. At the Commission’s January 16, 2024, Decision Meeting, Staff presented a Decision Memorandum and stated it had reviewed the Company’s filing made in compliance with Order No. 36039 and recommended approval effective as of January 1, 2024. COMMISSION FINDINGS AND DISCUSSION The Commission has jurisdiction over the Company and the issues in this case under Title 61 of the Idaho Code. Specifically, the Commission regulates “public utilities,” including “electric corporations” that serve the public or some portion thereof for compensation. After reviewing the Company’s compliance filing and Staff’s subsequent recommendation, we are satisfied with the Company’s updated Sheet No. 12R.8 of Regulation No. 12, as filed. The January 4, 2024, filing fully complies with the Commission’s requirements in Order No. 36039. Therefore, the Commission approves the Company’s revised tariff, effective as of January 1, 2024. ORDER IT IS HEREBY ORDERED that the Company’s revised tariff as contained in its January 4, 2024 compliance filing is approved, effective as of January 1, 2024. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date upon this Order regarding any matter decided in this Order.
