CASE NO. PAC-E-22-17
ORDER NO. 35593
On October 28, 2022, Rocky Mountain Power (“Company”) applied to increase the current
authority to borrow short-term debt and extend that authority for five years. The Company
requested an order be issued by December 15, 2022.
Commission Staff (“Staff”) recommended that the Commission extend the deadline for
good cause under Idaho Code § 61-904, to December 15, 2022.
COMMISSION FINDINGS AND DECISION
The Company is an Idaho corporation with its principal office in Boise, Idaho. The
Company is also an electric corporation as defined by Idaho Code § 61-119, and a public utility
as defined in Idaho Code § 61-129. The Commission has jurisdiction over this matter pursuant to
Title 61 of the Idaho Code, including without limitation Idaho Code §§ 61-501, and 61-901
through 61-909.
Statutorily, “all applications for the issuance, assumption or guarantee of securities shall
be disposed of promptly, and within thirty (30) days after petition is filed with the [C]ommission,
unless it is necessary, for good cause, to continue same for a longer period.” Idaho Code § 61-904.
In this case, November 27, 2022, is the thirty (30) day deadline to promptly dispose of the
Company’s Application as dictated by Idaho Code § 61-904. Between the limited decision
meetings, the holiday, and the need for additional analysis, Staff requested an extension from
November 27, 2022, to December 15, 2022, which based on the circumstances cited, we find
reasonable.
Based on our review of the record, we find that there is good cause to extend the final order
deadline from November 27, 2022, to December 15, 2022. The extended order deadline will allow
Staff to complete its analysis and maintains the Company’s requested issuance date of December
15, 2022.
ORDER NO. 35593 2
ORDER
IT IS HEREBY ORDERED that that good cause has been shown on the record to extend
the final order deadline to December 15, 2022.
THIS IS AN INTERLOCUTORY ORDER, not a final or appealable order of the
Commission. The period of reconsideration will not begin until the final order is issued.
DONE by Order of the Idaho Public Utilities Commission at Boise, Idaho this 14th day of
November 2022.
