HomeMy WebLinkAbout20230111Notice_of_Amended_Comment_Deadlines_Order_No_35662.pdfNOTICE OF AMENDED COMMENT DEADLINE NOTICE OF EXTENSION OF SUSPENSION ORDER NO. 35662 1 Office of the Secretary Service Date January 11, 2023 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On August 25, 2022, Rocky Mountain Power, a division of PacifiCorp (“Company”) applied for authority to implement a Class 1 commercial and industrial demand response program (“Program”). The Company requested that this Program be implemented under the existing Schedule 114 load management flexible tariff within the demand side management portfolio. The Company asked that the Application be processed by Modified Procedure with an effective date of January 1, 2023. On October 20, 2022, the Commission issued a Notice of Application, set an intervention deadline, and suspended the proposed effective date until February 15, 2023. Order No. 35568. P4 Production, L.L.C., an affiliate of Bayer Corporation (“Bayer”), and Idaho Irrigation Pumpers Association, Inc. (“IIPA”) (collectively the “Intervenors”) intervened. On December 8, 2022, the Commission issued a Notice of Modified Procedure establishing public comment and Company reply deadlines. Order No. 35616. At the Commission’s January 3, 2023, Decision Meeting, Staff conveyed to the Commission that through discovery, the Company provided Staff new data specific to Idaho which will take Staff additional time to process. To give Staff and the Intervenors adequate time to review the Idaho-specific data, work with the Company to determine the relevant information necessary, and make its subsequent recommendation, Staff recommended the Commission (1) vacate the comment deadlines established in Order No. 35616 and issue new comment deadlines; and (2) modify the suspension of proposed effective date. The Company and intervenors supported modifying the deadlines as proposed by Staff. PAC-E-22-13 NOTICE OF AMENDED COMMENT DEADLINES NOTICE OF EXTENSION OF SUSPENSION ORDER NO. 35662 NOTICE OF AMENDED COMMENT DEADLINE NOTICE OF EXTENSION OF SUSPENSION ORDER NO. 35662 2 With this Order, the Commission provides a Notice of Amended Comment Deadlines as well as a Notice of Extension of Suspension. NOTICE OF AMENDED COMMENT DEADLINES YOU ARE HEREBY NOTIFIED that the Commission finds it reasonable to vacate the comment deadlines set in Order No. 35616 and set new deadlines to allow the parties adequate time to review responses to production requests and file comments and reply comments. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application must file a written comment in support or opposition with the Commission by February 23, 2023. YOU ARE FURTHER NOTIFIED that the Company must file any reply comments by March 9, 2023. NOTICE OF EXTENSION OF SUSPENSION YOU ARE FURTHER NOTIFIED that the Commission suspended the Company’s proposed effective date of January 1, 2023, until February 15, 2023, in Order No. 35568. The Commission finds it reasonable based on the facts provided at the January 3, 2023, Decision Meeting to extend the suspension of the proposed effective date until April 1, 2023, to allow the Parties adequate time to review the Company’s responses to production requests. O R D E R IT IS HEREBY ORDERED that the comment deadlines established in Order No. 35616 are vacated. IT IS FURTHER ORDERED that interested persons must file any comments by February 23, 2023, and the Company must file any reply comments by March 9, 2023. IT IS FUTHER ORDERED that the suspension of the Company’s proposed effective date is extended to April 1, 2023, unless the Commission issues a final order prior to that time. THIS IS AN INTERLOCUTORY ORDER, not a final and appealable Order of the Commission. The period of reconsideration will not begin until the final Order is issued. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022. Generally, all pleadings should be filed with the Commission electronically and will be deemed timely filed when received by the Commission Secretary. See Rule 14.02.
