On May 18, 2022, Rocky Mountain Power (“Company”) and Amy Family Holdings
(“Seller”) (collectively, the “Parties”) entered into a 20-year renewal PPA. On June 16, 2022, the
Commission issued Order No. 35433 which established a public comment deadline of July 15,
2022, and a reply comment deadline of July 22, 2022. After issuance of Order No. 35433, the
Commission Staff (“Staff”) discovered that the Company never filed an amended agreement
(“Amendment”) as directed by the Commission in Case No. PAC-E-20-18 for the one-year
extension the Parties previously applied for authority to enter.1 See Order No. 35262. Because the
Amendment is the baseline for determining the avoided cost rates for the 20-year PPA, Staff cannot
review the Application in the present case until the Amendment is approved by Commission order
in Case No. PAC-E-20-18.
At the Commission’s July 12, 2022 Decision Meeting, Staff recommended vacating the
public comment and reply comment deadlines established in Order No. 35433 and establishing a
new 14-day public comment deadline, and 21-days for the reply comment deadline.2
Having reviewed Staff’s recommendations, we now issue this Order vacating the comment
deadlines established in Order No. 35433 and establish new public comment and reply deadlines.
1 Order No. 35262 conditioned the approval of the one-year extension in Case No. PAC-E-20-18 on the change of the
Facility’s nameplate capacity and inclusion of bifurcated rates in the Amendment.
2 At the July 12, 2022, Decision Meeting, Staff communicated to the Commission that it had reviewed the Amendment
filed on June 14, 2022, in compliance with Order No. 35262, and believed it complied with the Commission’s direction
in Order No. 35262. Staff recommended the Commission approve the Amendment. The Commission moved to
approve the Amendment as filed, which the Commission unanimously agreed to. An order memorializing the
Commission’s decision in Case No. PAC-E-20-18 will be entered subsequently.

YOU ARE HEREBY NOTIFIED that based on the requirements in Case No. PAC-E-20-
18, and the need to first approve the compliance filing in that case, we find it reasonable to amend
the comment deadlines that were previously established in Order No. 35433.
YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this
Application may file a written comment explaining why they support or oppose the Application.
Persons who would like a hearing must specifically request a hearing in their written comments.
Interested persons shall have fourteen (14) days from the service date upon this Order to file
written comments. Comments must be filed through the Commission’s website or by e-mail
unless computer access is unavailable. To comment electronically, please access the Commission’s
website at www.puc.idaho.gov. Click the “Case Comment Form” and complete the form using the
case number as it appears on the front of this document. To file by e-mail, the customer must e-
mail the comments to the Commission Secretary and the Company at the e-mail addresses listed
below. If computer access is unavailable, then comments may be mailed to the Commission and

YOU ARE FURTHER NOTIFIED that the Parties must file any reply comments within
twenty-one (21) days of the service date upon this Order.
YOU ARE FURTHER NOTIFIED that if no written comments or protests are received
within the time limit set, the Commission will consider this matter on its merits and enter its order
without a formal hearing. If written comments are received within the time limit set, the
Commission will consider them and, in its discretion, may set the same for formal hearing.
O R D E R
IT IS HEREBY ORDERED that the public comment and reply deadlines established in
Order No. 35433 are VACATED.
IT IS FURTHER ORDERED that the persons interested in submitting written comments
must do so within fourteen (14) days of the service date upon this Order. The Parties must file
any reply comments within twenty-one (21) days of service date upon this Order.
IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21,
2022. Generally, all pleadings should be filed with the Commission electronically and will be
deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between
parties should continue to be accomplished electronically when possible. However, voluminous
discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
