HomeMy WebLinkAbout20211008Decision Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER KJELLANDER COMMISSIONER RAPER COMMISSIONER ANDERSON COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: ERICK SHANER DEPUTY ATTORNEY GENERAL DATE: OCTOBER 6, 2021 SUBJECT: IN THE MATTER OF ROCKY MOUNTAIN POWER’S APPLICATION FOR AUTHORITY TO IMPLEMENT A BATTERY DEMAND RESPONSE PROGRAM; CASE NO. PAC-E-21-16. On July 15, 2021, PacifiCorp dba Rocky Mountain Power (“Company”) applied to the Commission for an order approving a new and flexible Schedule 114 load management tariff within the demand side management (“DSM”) portfolio. Application at 1, 2, and 12. The new tariff would fund implementation of a “Class 1 battery demand response program (“Wattsmart Battery” or “Program”) . . .” Id. at 1. The Company requested an October 15, 2021, effective date and requested that its Application be processed by Modified Procedure. Id. at 12. On August 19, 2021, the Commission issued a Notice of Application, set an intervention deadline, and suspended the proposed effective date “for thirty (30) days and five months or until the Commission enters an order accepting, rejecting, or modifying the proposed rate increases.” Order No. 35139 at 3. The effective date was suspended to give Commission Staff and interested persons adequate time to evaluate the Application. Id. Idaho Irrigation Pumpers Association, Inc. timely intervened. Thereafter on September 15, 2021, the Commission issued a Notice of Parties. Commission Staff has informally conferred with the parties regarding procedure and schedule. STAFF RECOMMENDATION Staff recommends the Commission process this matter by Modified Procedure, setting a December 16, 2021, comment deadline and a January 6, 2022, reply comment deadline.
