BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION

On December 3, 2020, Rocky Mountain Power (“Company”) applied to the Commission
seeking approval or rejection of an amendment to extend for one-year an existing Energy Sales
Agreement (“ESA”) the Company has with Amy Family Holdings, LLC (“Seller”) to allow the
parties to secure a stand-alone interconnection agreement replacing the interconnection provision
in the existing ESA.
On December 20, 2021, the Company’s Application was approved, on the condition that
the Company file an amended agreement (“Amended Agreement”) with the Commission
incorporating Staff’s recommendations to ensure the amendment correctly reflected actual
installed nameplate capacity and the use of bifurcated rates during the one-year extension. Order
No. 35262. The Company filed the Amended Agreement on June 14, 2022.
On July 12, 2022, at the Commission’s decision meeting, Staff informed the Commission
that the Company had filed the Amended Agreement and recommended approval.
COMMISSION FINDINGS AND DECISION
After reviewing the Company’s Amended Agreement, we find the edits are consistent with
our directives in Order No. 35262. Accordingly, we accept the Company’s Amended Agreement
as filed.
O R D E R
IT IS HEREBY ORDERED that the Amended Agreement between the Company and the
Seller is accepted as, filed, effective from January 1, 2022 through December 31, 2022.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for
reconsideration within twenty-one (21) days of the service date of this Order about any matter
decided in this Order. Within seven (7) days after any person has petitioned for reconsideration,
any other person may cross-petition for reconsideration. See Idaho Code § 61-626.
