BACKGROUND The Company submits its Application for approval under the Idaho Electric Supplier Stabilization Act,Idaho Code §§61-332 through 61-334C and the electric utility asset transfer statute,Idaho Code §61-328.The Company requested that its Application be processed under Modified Procedure,Rule 201 et seq.See IDAPA 31.01.01.201 through .204 (that is,through written submissions without a live hearing).However,the latter statute states the Commission "shall issue a public notice and shall conduct a public hearing upon the application (emphasis added)."Therefore Staff recommended both Modified Procedure with a comment period running through October 25,2018 and a reply deadline of November 1,2018,as well as a telephonicpublic hearing on October 16,2018. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that with this Application,the Company asks the Commission to approve the Company's Customer Transfer Agreement with the City of Idaho Falls.A copy of the agreement is attached to the Application. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF TELEPHONIC HEARING ORDER NO.34142 1 YOU ARE FURTHER NOTIFIED that the Company proposes to relinquish electrical service to two small communications facilities owned by Cable One and CenturyLink.These communications facilities were attached to Company-owned facilities that have been de-energized and removed.The City has agreed to accept the authority and obligation to serve the communications facilities. YOU ARE FURTHER NOTIFIED that the Company and the City have agreed to transfer service to the specified customers at no cost to any party. YOU ARE FURTHER NOTIFIED that the Company and City have agreed that no Company facilities will be transferred to the City as a result of the agreement. YOU ARE FURTHER NOTIFIED that the Application and supporting documentation have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices.These documents are also available on the Commission's web site at www.puc.idaho.gov.Click on the "Open Cases"link under the heading "Electric"and click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission's Rules of Procedure,IDAPA 31.01.01.000et seq. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission's jurisdiction under Title 61 of the Idaho Code,specifically Idaho Code §§61-502 and 61-503.The Commission may enter any final Order consistent with its authorityunder Title 61. NOTICE OF TELEPHONIC PUBLIC HEARING YOU ARE FURTHER NOTIFIED that the Commission's Rules of Modified Procedure contemplate that a case will be processed by written submissions without the need for a public hearing.However,the Commission finds good cause to schedule a public hearing in this case because the Company filed its Application under Idaho Code §61-328,and that statute requires a public hearing. YOU ARE FURTHER NOTIFIED that the Commission will conduct a public telephonic customer hearing in this matter on TUESDAY,OCTOBER 16,2018 AT 11:00 A.M.
