HomeMy WebLinkAbout20180424order_no_34041.pdfOffice of the Secretary Service Date April 24,2018 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION )CASE NO.PAC-E-17-07 OF ROCKY MOUNTAIN POWER FOR A )CERTIFICATE OF PUBLIC CONVENIENCE )ORDER NO.34041 AND NECESSITY AND BINDING )RATEMAKING TREATMENT FOR NEW )WIND AND TRANSMISSION FACILITIES ) On July 31,2017,Rocky Mountain Power moved the Idaho Public Utilities Commission (Commission),under Commission Rules of Procedure 19 and 43.03 and Idaho Bar Commission Rule (IBCR)227,for an Order approving the limited admission,pro hac vice,of Katherine McDowell in this matter.The Motion was signed and attested to by local counsel Adam Lowney of Portland,Oregon (Idaho State Bar License No.10456). In the Motion,Ms.McDowell certifies that she is an active member in good standing of the Oregon State Bar who maintains the regular practice of law in Oregon.She further declares that she is not an Idaho resident or licensed to practice law in Idaho. Ms.McDowell and Mr.Lowney certify that a copy of the Motion has been served on all other parties to this case,and that a copy of the Motion,accompanied by a $325 fee and certificate of good standing,have been submitted to the Idaho State Bar.Mr.Lowney acknowledges that his attendance shall be required at all Commission proceedings in which Ms. McDowell appears,unless specifically excused by the Commission. COMMISSION FINDINGS The Commission has reviewed and considered the Motion and applicable rules, including IBCR 227 and Commission Rules of Procedure 19 and 43.03,IDAPA 31.01.01.019 and 043.03.Based on the filings of record and certified representations of Ms.McDowell and Mr.Lowney,we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Ms.McDowell as legal counsel for Rocky Mountain Power.We further find good reason to excuse the appearance of Mr.Lowney in further proceedings in this docket unless needed by Ms.McDowell. ORDER NO.34041 1 CONCLUSIONS OF LAW The Commission has jurisdiction in this case and over this Motion pursuant to Idaho Code,Title 61,and the Commission's Rules of Procedure,31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Motion is granted;Katherine McDowell is hereby granted limited admission as legal counsel for Rocky Mountain Power. IT IS FURTHER ORDERED that the attendance of Adam Lowney is excused from all further proceedings in Case No.PAC-E-17-07 unless needed by Katherine McDowell.
