HomeMy WebLinkAbout20120321final_order_no_32497.pdfOffice of the Secretary Service Date March 21,2012 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION ) OF PACIFICORP DBA ROCKY MOUNTAIN )CASE NO.PAC-E-12-05 POWER FOR APPROVAL OF ITS ) ELECTRIC SERVICE AGREEMENT WITH ) MONSANTO COMPANY PURSUANT TO )ORDER NO.32497 ORDER NO.32432 ) __________________________________________________________________________________ ) On March 5,2012,PacifiCorp dba Rocky Mountain Power (“Rocky Mountain Power”or “Company”)and Monsanto Company (“Monsanto”)submitted a joint request seeking a Commission “Order approving the Electric Service Agreement (the ‘ESA’)entered into between Rocky Mountain Power and Monsanto.”Petition at 1. THE COMPANY’S FILING The new ESA was required under the provisions of a settlement stipulation accepted by the Commission in Order No.32432,Case No.PAC-E-11-12.The Commission’s Order established new rates for Monsanto in 2012 that included a new interruptibility credit.The ESA also includes the calendar year 2013 rates and credit required by the Commission’s Order.The new ESA expires at the end of 2013. Under the terms of the stipulation as cited in item 6 on page 4 of Order No.32432, Monsanto’s rates are also subject to adjustment by Rocky Mountain Power’s Energy Cost Adjustment Mechanism (ECAM).The Company noted that the Order acknowledged the filing of the parties’ESA on December 23,2011,but did not specifically accept or approve the Agreement. STAFF REVIEW AND RECOMMENDATION Staff reviewed the confidential ESA and found that it was similar to previous ESAs approved by the Commission.Staff believes that the terms and conditions are reasonable and that they reasonably protect Rocky Mountain Power’s other customers.Staffs review confirmed that the ESA meets the requirements of the settlement stipulation accepted by the Commission in Final Order No.32432. Staff recommended Commission approval of the ESA with an effective date of January 10,2012,as proposed by Rocky Mountain Power and Monsanto. ORDERNO.32497 1 COMMISSION FINDINGS AND DECISION The Commission has reviewed Rocky Mountain Power and Monsanto’s joint Application requesting an Order approving the Company’s ESA with Monsanto.The Commission finds that the ESA comports with the terms of the stipulation agreed to by Monsanto and Rocky Mountain Power in the Company’s last general rate case,PAC-E-l 1-12, and approved by this Commission on January 10,2012.See Order No.32432 at 21.Therefore, the Commission approves the parties’Agreement. ORDER IT IS HEREBY ORDERED that the Application filed by Rocky Mountain Power and Monsanto requesting a Commission Order approving their Electric Service Agreement entered into pursuant to Commission Order No.32432 is approved.The terms and conditions of the ESA shall be effective as of January 10,2012. THIS IS A FINAL ORDER.Any person interested in this Order may petition for reconsideration within twenty-one (21)days of the service date of this Order.Within seven (7) days after any person has petitioned for reconsideration,any other person may cross-petition for reconsideration.See Idaho Code 6 1-626.
