PAC-E-\~-C6 PETITION OF ROCKY MOUNTAIN POWER FOR APPROV AL OF ELECTRIC SERVICE AGREEMENT COMES NOW, PacifiCorp, d//a Rocky Mountain Power ("Rocky Mountain Power") and Monsanto Company ("Monsanto"), and pursuant to RP 53, hereby respectfully petition the Idaho Public Utilties Commission (the "Commission") for an Order approving the Electric Service Agreement (the "ESA") entered into between Rocky Mountain Power and Monsanto. The Monsanto ESA became effective January 10, 2012, the date the Commission issued its final order, Order No. 32432, in Case No. PETITION OF ROCKY MOUNTAIN POWER - 1 PAC-E-11-12, and was previously filed with the Commission in this Case. In support of their petition, Rocky Mountain Power and Monsanto state as follows: 1. PacifiCorp, an Oregon corporation, is an electrical corporation and public utilty doing business as Rocky Mountain Power in the state of Idaho and is subject to the jurisdiction of the Commission with regard to its public utilty operations. PacifiCorp also provides retail electric service in the states of Utah, Oregon, Wyoming, Washington, and California. 2. Monsanto Company is a Delaware corporation that owns and operates an elemental phosphorous plant at a site near Soda Springs City, Idaho in Caribou County. 3. As part of the stipulation entered into by Rocky Mountain Power, Monsanto, Commission Staff, Idaho Irrigation Pumper Association, and PacifiCorp Idaho Industrial Customers in this Case, the paries agreed to a new valuation of Monsanto's curailment products in 2012 and 2013. Monsanto and the Company agreed to execute a new ESA for 2012 and 2013 in order to reflect the terms of the Stipulation. 4. Monsanto and Rocky Mountain Power executed the ESA pursuant to the terms of the Stipulation, and fied it with the Commission on December 23,2011. 5. The Commission, in Order No. 32432, noted that the ESA had been executed and fied, but did not accept or approve the ESA. Accordingly, the Company is making the curent filing for approval of the ESA, which as noted above, became effective Januar 10,2012, upon the issuance of Order No. 32432. 6. The Company and Monsanto respectfully submit that the Commission's approval of the ESA as agreed to by the parties to the Stipulation, is in the public interest. PETITION OF ROCKY MOUNTAIN POWER - 2 CONCLUSION WHEREFORE, Rocky Mountain Power and Monsanto respectfully request that the Commission issue a final order approving the Company's proposed electric service agreement with Monsanto, effective January 10,2012.
