PAC-E-I0-07 ) ) ) MOTION TO STRIKE ) ) ) ) ROCKY MOUNTAIN POWER'S MOTION TO STRIKE Rocky Mountain Power hereby submits its motion to the Idaho Public Utilities Commission ("Commission") to strike all testimony filed by Monsanto, Inc. ("Monsanto") on November 1,2010, that relates to the valuation of Monsanto's interrptible products. In support of its motion, Rocky Mountain Power states as follows: 1 1. On October 22, 2010, the Commission issued Order No. 32098, in which it: (1) denied the Motion of Monsanto to Dismiss or strke; (2) tolled the suspension period for the Company's 2010 rate case for 61, days; (3) continued the existing interrptible credit (and terms of service) under the Monsanto contract until February 28, 2011; (4) adopted a procedural schedule for the issue of economic valuation of the Monsanto interrptible product; and (5) required all parties to separate out the issue of the valuation of Monsanto's interrptible product and refie their direct testimony on all other issues on or before November 1,2010. 2. Despite the clear direction in Order No. 32098, the testimony fied November i, 2010, by Monsanto witnesses Smith, Collins, and Iverson contains substantial discussion of the valuation of Monsanto' s interrptible product. 3. Accordingly, Rocky Mountain Power requests that the Commission strike and disregard any statements made in the testimony filed by Monsanto regarding the valuation of Monsanto's interrptible product; disregard any references thereto; and prevent Monsanto witnesses from discussing or referencing this portion of their testimony durng the hearing scheduled for November 30, December 1, and December 2,2010. 4. To allow these statements into the record, or testimony regarding the valuation during this phase of the proceedings provides Monsanto with the proverbial second bite at the apple, and is a blatant attempt to color the Commission's consideration of these issues prior to the phase of the proceedings explicitly set aside for this matter. 2 '" WHEREFORE, Rocky Mountain Power respectfully requests the following: 1. That the Commission grant Rocky Mountain Power's motion to strike any and all references to the valuation of Monsanto's interruptible product from the testimony fied by Monsanto on November 1, 2010, that the Commission disregard any reference thereto, and prevent any testimony on the valuation issue at the hearings scheduled for November 30, December 1, and December 2, 2010.
