PAC-O8- NOTICE OF PUBLIC HEARING (SETTLEMENT STIPULATION) On September 19, 2008, PacifiCorp dba Rocky Mountain Power (Rocky Mountain Power; Company) filed an Application with the Idaho Public Utilities Commission (Commission) for authority to increase the Company s base rates for electric service by $5. million annually, or 4.0%. The increase in base rates would vary by class of customer and actual usage. The rate increase does not apply to Agrium or Monsanto, whose rates are controlled by a separate Commission-approved Stipulation. Intervening parties to this case are: Monsanto Company; Idaho Irrigation Pumpers Association, Inc.; Community Action Partnership of Idaho; and Agrium, Inc. On February 5, 2009, a Stipulation and Proposed Settlement that purports to resolve all issues raised in this proceeding was filed by PacifiCorp, Commission Staff, Idaho Irrigation Pumpers Association and Community Action Partnership of Idaho. The Stipulation does not impact or propose any changes to Monsanto or Agrium s rates. Monsanto participated in the settlement discussion and while it does not adopt the Stipulation it has no objection to the Commission approving the same. Under the terms of the Stipulation, Rocky Mountain Power would be authorized to recover $4 382 632 (3.1 %) in additional annual electric revenue from non-contract customers.The increase would be effective April 18, 2009 for all affected customers. On February 11, 2009, the Commission issued a Notice of Stipulation and Proposed Settlement in Case No. P AC-08-07 setting forth the terms of the Stipulation and scheduling a technical and evidentiary hearing on the Settlement Stipulation for March 11 , 2009 in Boise Idaho. NOTICE OF PUBLIC HEARING YOU ARE HEREBY NOTIFIED that the Commission will hold a public hearing in eastern Idaho for the purpose of receiving public comment in Case No. PAC-08-07. The NOTICE OF PUBLIC HEARING (SETTLEMENT STIPULATION) hearing for Rocky Mountain Power customers will commence on TUESDAY. MARCH 17. 2009. AT 7:00 P.M. AT SHELLEY CITY HALL LOCATED AT 101 SOUTH EMERSON AVENUE IN SHELLEY. IDAHO At this hearing customers and other interested parties will have an opportunity to offer sworn testimony regarding the Stipulation and Proposed Settlement. YOU ARE FURTHER NOTIFIED that all hearings in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other assistance in order to participate in or to understand testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and specifically Idaho Code 99 61-302, 61-307, 61-502, 61-503, 61-507, 61-622, and 61-623. The Commission may enter any final Order consistent with its authority under Title 61.
