CASE NO. PAC-E-08-07
MOTION FOR CLARFICATION AND CORRCTION
Rocky Mountan Power (th "Company") hereby submits its motion for clarification and
correction to the Idaho Public Utilties Commission ("Commssion") requesting the Commission
issue an order clarfying and correcting Order No. 30783 (the "Order"). In support of its motion,
Rocky Mounta Power states as follows:
1. In reviewig Order No. 30783, Rocky Mountan Power has discovered what it
believes is two errors in the Order tht do not match the Stipulation as agreed to by Rocky
Mounta Power, the Idao Irgation Pupers Association, the Communty Action Parership
of Idao, and Commission Sta, and fied with the Commission on Febru 5, 2009. Rocky
Mountan Power believes that it was the Commission's intent to have the Order reflect the terms
and conditions of the Stipulation, and that correcting these errors would be in the public interest.
1
2. The first correction tht Rocky Mounta Power respectfly requests the
Commssion make occurs in the second ful paragraph of page 1 of the Orer, and again in the
second ful paragrph of page 10. In both instaces, the Order states that the rates of Monsanto
and Agrum increased 3% on Janua 1,2009, and will increase an additional 5% on Janua 1,
2010. Whle these increases are corrct for Monsanto, the rates for Agrum will increase an
additional 7%, not 5%, on Januar 1,2010. Rocky Mountan Power does not believe tht ths
was the Commssion's intent and requests the Commission make ths change to Order No.
30783. Grting this corrction wil align ths order with the Commission's originl Order No.
30482 that authorized and specified the terms of Agrum's service agreement.
3. Second; Rocky Mountan Power believes that tariff schedules 1, 19, and 36 that
were approved by this Order conta an error. Rocky Mountan Power adts that this error wa
made by the Company and was not identified until Commission Sta was performg their fial
review of the taff fiing made by the Company in Case No. P AC-E-08-07. Commission Sta
contacted the Company and asked to verify the calculation of the temperatue adjustments in
Exhbit 30 of the filing.
4. Upon review by the Company with Commission Staff of ths adjustment, an error
was identified in the calculation of the temperatue adjustment revenues for Schedules 1, 19 and
36. These schedules indvertently contain an adjustment for the previously effective Rate
Mitigation Adjustment (taff Schedule No. 94) which should have ben removed from the
calculations. The revenue impact of this error was a reduction in proposed rates for Schedule 1
and 36 reducing the abilty to collect electrc revenues by $30,788 and $808 respectively and an
increase in proposed rates resulting in a revenue increase of $1,702 for Schedule 19.
2
5. The $29,894 revenue impact of these errors is sumarzed by taff schedule in
the attched Table 1. This atthment highights the change in the temperatue adjustment
revenues, shows the Stipulation actu revenues being collected, and highights the tota revenues
by rate schedule that will be collected under the presently ordered rates and though revised rates
fied with ths motion for clarfication.
6. Rocky Mountain Power believes that the intent of the Commission order was to
approve taffs that would allow the Company to recover $4,382,632 of additional anual electrc
revenue as specified in the Stipulation. The corrctions to taff schedules 1, 19, and 36
proposed herein adjust the rates to collect properly the revenues ordered by the Commssion
through the proposed tates.
WHREFORE, Rocky Mountain Power respectfully requests the followig:
1. That the Commission grt Rocky Mountan Power's request for clarfication and
correction.
2. Tht the Commssion order that the corrected taff sheets, as described in
paragraphs 4 and 5 above and the atthed Table 1, be accepted for filing.
DATED ths 23rd day of April 2009.
Respectfuly submitted,
ROCKY MOUNTAIN POWER
