PAC-07- ELECTRIC COOPERATIVE, INC. AND ROCKY MOUNTAIN POWER FOR NOTICE OF ORDER APPROVING THE SALE AND JOINT APPLICATION TRANSFER OF PROPERTY NOTICE OF MODIFIED PROCEDURE ORDER NO. 30347 YOU ARE HEREBY NOTIFIED that on June 5, 2007, Fall River Rural Electric Cooperative, Inc. (Fall River) and Rocky Mountain Power (Rocky Mountain) filed a Joint Application requesting approval of the sale and transfer of property from Rocky Mountain to Fall River. Fall River is a rural electric cooperative that provides service for its members in and around the City of Driggs, Idaho. Rocky Mountain is a public utility subject to regulation by the Commission and provides service in southeastern Idaho, including in an area immediately adjacent to Fall River s existing service territory. The Application states that both companies have provided service to customers in the Teton County Basin, and as the Basin experiences growth, the potential for the duplication of facilities increases, presenting planning and operational issues for both companies. Accordingly, the parties reached an agreement to transfer certain electric facilities from Rocky Mountain to Fall River, along with a service territory that would affect approximately 150 customers of Rocky Mountain. YOU ARE FURTHER NOTIFIED that the Application states that the agreement is in the public interest because of the closer proximity of Fall River facilities to the affected customers. The Application also asserts that the transfer will not increase rates for the affected customers because Fall River has agreed to serve the customers under Rocky Mountain s rate structure for a period of five years. The Application also states that the transfer is consistent with the Idaho Electric Supplier Stabilization Act, which is intended to promote harmony among and between electric suppliers and to discourage duplication of electric facilities. YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30347 Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure, IDAP A 31.01.01.20 1-204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within twenty-one (21) days from the service date of this Notice. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. YOU ARE FURTHER NOTIFIED that the Application and supporting workpapers testimonies and exhibits have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices or on the Commission Website at www.puc.idaho.gov under the "File Room" and "Electric Cases. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Joint Application of Fall River Rural Electric and Rocky Mountain requesting approval for the sale and transfer of property from Rocky Mountain Power to Fall River be processed by Modified Procedure, IDAPA 31.01.01.201-204. Persons interested in submitting written comments in this matter must do so no later than 21 days from the service date of this Order.
