P AC-07- ORDER NO. 30451 On October 3 and 4, 2007, PacifiCorp dba Rocky Mountain Power caused to be filed with the Idaho Public Utilities Commission (Commission) Motions for the Limited Admission of Justin Lee Brown, Esq. and Katherine A. McDowell, Esq. in Case No. P AC-07-05 (reference Idaho Bar Commission Rule 222; IPUC Rules of Procedure 19 and 43.05). The local Idaho counsel filing the Motions is John R. Hammond, Jr., Fisher Pusch & Alderman, LLP, U S Bank Plaza, Fifth Floor, 101 South Capitol Boulevard, PO Box 1308 , Boise, Idaho 83701. Justin Lee Brown certifies that he is an active member in good standing with the Bar of the State of Utah and that he maintains a regular practice of law at Rocky Mountain Power 201 South Main Street, Suite 2300, Salt Lake City, Utah 84111. Mr. Brown further certifies that he is not a resident of the State of Idaho or licensed to practice in Idaho and that he has not previously sought admission under mCR 222. Katherine A. McDowell certifies that she is an active member in good standing of the Bar of the State of Oregon and that she maintains a regular practice of law at McDowell & Rackner PC, 520 Southwest Sixth Avenue, Suite 830, Portland, Oregon 97204. Ms. McDowell further certifies that she is not a resident of the State of Idaho or licensed to practice in Idaho and that she has not previously sought admission under IBCR 222. Both Mr. Brown and Ms. McDowell and local counsel, Mr. Hammond, certify that copies of the respective Motions, accompanied by a $200 fee for each, have been provided to the Idaho State Bar. Mr. Hammond acknowledges that as local counsel, his attendance shall be required at all proceedings before the Commission in which Mr. Brown and Ms. McDowell appear, unless specifically excused by the Commission. In this regard, John R. Hammond, Jr. respectfully requests that the Commission excuse him from having to appear during Commission proceedings in the above captioned matter unless needed by Rocky Mountain Power. ORDER NO. 30451 Commission Findings The Commission has reviewed and considered the Motions for Limited Admission filed in Case No. P AC-07-05 and the related practice rules and Rules of Procedure, i., Idaho Bar Commission Rule 222 (Limited Admission - Pro Hac Vice) and Commission Rules of Procedure 19 and 43., IDAPA 31.01.01.019 and 043.05. Based on the filings of record and certified representations of Mr. Hammond and Mr. Brown and Ms. McDowell, we find that reasonable grounds have been demonstrated to justify the granting of limited admission of Mr. Brown and Ms. McDowell as legal counsel for PacifiCorp dba Rocky Mountain Power in Case No. PAC-07-05. We further find good reason to excuse the appearance of Mr. Hammond in further proceedings in this docket unless needed by Rocky Mountain Power. CONCLUSIONS OF LAW The Commission has jurisdiction in Case No. PAC-07-05 and the Motions for Limited Admission filed by John R. Hammond, Jr., local counsel, and Justin Lee Brown and Katherine A. McDowell, applying counsel, pursuant to Idaho Code, Title 61 , and the Commission s Rules of Procedure, 31.01.01.000 et seq. ORDER In consideration of the foregoing and as more particularly described above, IT IS HEREBY ORDERED and Justin Lee Brown and Katherine A. McDowell are hereby granted limited admission in Case No. P AC-07-05 as legal counsel for the applicant, PacifiCorp dba Rocky Mountain Power. IT IS FURTHER ORDERED that the attendance of John R. Hammond, Jr. is excused from all furthering proceedings in Case No. PAC-07-05 unless needed by Rocky Mountain Power.
