On September 1 , 2006, PacifiCorp dba Rocky Mountain Power filed a petition
seeking a declaratory order that the Company s current funding structure for its Low Income
Weatherization Program contained in tariff Schedule 21 is just and reasonable. In subsequent
Orders, the Commission granted intervenor status to Community Action Partnership Association
of Idaho (CAP AI) and set this matter for hearing. As set out in scheduling Order No.3 0169, the
Staff and CAP AI were to file their direct testimony on December 20, 2006 and their rebuttal
testimony (if necessary) on January 10 2007. The Commission s technical hearing in this matter
is scheduled for February 2 2007.
On December 18, 2006, the Commission Staff filed a Joint Motion to postpone the
filing of direct testimony. Staff explained in its Motion that the parties had agreed in principle to
settle this case. Based upon the settlement, Staff and CAP AI requested that the Commission
postpone the December 20 deadline for their prefiled testimony. Instead, they requested
permission to file their testimony in support of the settlement on January 10, 2007. The Motion
stated that no other changes to the schedule are necessary and that the Commission may retain
the existing February 2, 2007 hearing date to examine the proposed settlement.
Based upon the Staffs Joint Motion, we find there is good cause to grant the Motion.
Staff and CAP AI are directed to file their testimony in support ofthe settlement on January 10
2007.
ORDER
IT IS THEREFORE ORDERED that the Staffs Joint Motion is granted. Staff and
CAPAI shall file their direct testimony on January 10 2007.
IT IS FURTHER ORDERED that the parties shall comply with all the other filing
and hearing dates in the Commission s scheduling Order No. 30169.
