PAC-06- ORDER NO. 30169 On September 1 , 2006, PacifiCorp dba Rocky Mountain Power filed a petition seeking a declaratory order that the Company s current funding structure for its Low Income Weatherization Program (Schedule 21) is just and reasonable. The Company requested that this matter be processed by Modified Procedure. On September 22, 2006, the Community Action Partnership Association of Idaho (CAP AI) petitioned to intervene. CAP AI also objected to PacifiCorp s request to process the case under Modified Procedure and urged the Commission schedule the matter for hearing. On October 3 , 2006, the Commission issued its Notice of Petition and granted intervention status to CAP AI. The Commission also directed that the Commission Staff conduct an informal prehearing conference with the parties to establish a schedule for processing this case. Order No. 30139. The Commission Secretary issued the Notice of Parties on October 19 2006. THE PREHEARING CONFERENCE On October 24, 2006, the parties convened a telephonic prehearing conference. The parties participating in the conference included: Rocky Mountain, CAP AI, and the Commission Staff. The parties agreed on a proposed schedule and recommended that the Commission adopt the schedule set out below. DATE ACTION December 6, 2006 Deadline for discovery requests December 20, 2006 Deadline for Staff and CAP AI prefile testimony January 10 2007 Deadline for Staff/CAP AI rebuttal of each other (if necessary) NOTICE OF HEARING ORDER NO. 30169 January 24 2007 Deadline for PacifiCorp s prefile rebuttal testimony February 2, 2007 Technical Hearing in Boise Based upon the agreement of the parties, the Commission adopts the proposed schedule set out above. The parties also agreed on several issues related to service. More specifically, the parties agreed to a 10-day response period for discovery requests and to serve just one hard copy of discovery on the Commission Secretary. The parties also agreed to serve each other with discovery and prefile testimony by electronic mail. To conserve resources, the parties also agreed to serve the Commission with an original and four copies of all prefile testimony. IDAPA 31.01.01.061.03. The e-mail addresses for the parties are contained in the Notice of Parties issued October 19, 2006. The parties also agreed to convene an informal settlement conference prior to PacifiCorp s rebuttal testimony. The purpose of the settlement conference is to determine if the parties can settle some or all of their differences prior to the technical hearing. NOTICE OF HEARING YOU ARE HEREBY NOTIFIED that the Commission will convene a technical hearing in this matter commencing FEBRUARY 2. 2007 AT 10:00 M. YOU ARE FURTHER NOTIFIED that the prepared testimony and exhibits shall conform to the requirements of Rules 231 , 266, and 267 of the Commission s Rules of Procedure, IDAP A 31.01.01.231 , 266, 267. The parties ' assigned exhibit numbers are set out in the separate Notice of Parties. YOU ARE FURTHER NOTIFIED that the hearing in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other assistance in order to participate in or to understand testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing. ORDER IT IS HEREBY ORDERED that the parties comply with the case schedule set out above in the body ofthis Order. IT IS FURTHER ORDERED that service among the parties be accomplished by electronic mail pursuant to Rule 63 , IDAPA 31.01.01.063.
