P AC-06- NOTICE OF MODIFIED PROCEDURE NOTICE OF SCHEDULING NOTICE OF HEARING ORDER NO. 30117 Background Pursuant to Commission approved Stipulation in PacifiCorp s 2005 rate case (PAC- 05-, Order No. 29833) PacifiCorp agreed to file a general rate case no later than April 29 2006 to address cost of service issues not resolved in the 2005 Stipulation and to time the effective date of new rates to coincide with the expiration of the current Monsanto contract (December 31, 2006). The Company s 2006 filing was delayed to permit Company contract negotiations to proceed with Monsanto. The Company s filings in Case Nos. PAC-06-, 06- and 06-9 are intended to satisfy its 2005 Stipulation filing commitment. Applications On June 21 , 2006, PacifiCorp dba Rocky Mountain Power (PacifiCorp; Company) filed an Application with the Idaho Public Utilities Commission (Commission) in Case No. P AC- E-06-4 requesting authority to implement revised rates in electric tariff Schedules 10 (Irrigation), 400 (Monsanto Company) and 401 (Nu-West Industries). Simultaneous and related filings were made in Case Nos. PAC-06-8 (Nu-West Stipulation) and PAC-06-9 (Monsanto Service Agreement). The Company in its Case No. P AC-06-4 filing requests authority to implement revised tariff schedules that would result in a net increase in base rates of $8. million (5.1%) for retail customers under irrigation Schedule No. 10 ($1.7 million; 5%), Nu- West special contract Schedule No. 401 ($150 000; 4%) and Monsanto special contract Schedule No. 400 ($6.8 million; 16.5%). The proposed changes in tariff rates are agreed to by the Idaho NOTICE OF MODIFIED PROCEDURE NOTICE OF SCHEDULING NOTICE OF HEARING ORDER NO. 30117 Irrigation Pumpers Association (IIPA), Nu-West and Monsanto. No changes in rates are proposed for other Idaho customer classes. PacifiCorp requests that its filings be processed pursuant to Modified Procedure. Reference IDAPA 31.01.01.201-204. In a departure from the terms of the existing Nu-West agreement, Nu-West has agreed by Stipulation to allow for the proposed rate adjustment electric tariff Schedule 401 to be effective September 1 , 2006. PacifiCorp requests that Nu- West's Application be processed under Modified Procedure under a schedule that will permit an effective date of September 1 , 2006. In the event that a final Order regarding Nu- West cannot be issued before September 2006, PacifiCorp requests that the revised Nu-West Schedule 401 become effective September 2006 subject to refund at the time of the Commission s final Order. Notice of Application and Intervention Deadline in Case No. P AC-06-4 was issued on June 30, 2006. Community Action Partnership Association of Idaho (CAP AI) was the only party to file a Petition to Intervene. CAP AI was granted intervention. Reference Order No. 30103. YOU ARE HEREBY NOTIFIED that the Commission has reviewed the filings of record in Case No. P AC-06-4 and related filings in Case Nos. P AC-06-8 and P AC-06- The Commission has preliminarily found that the public interest in this matter may not require an evidentiary hearing to consider the issues presented, and that issues raised by the Company filing may be processed under Modified Procedure i.e., by written submission rather than by hearing. Reference Commission s Rules of Procedure, IDAPA 31.01.01.201-204. YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests by Staff, intervenors and others with respect to PacifiCorp s Application and the use of Modified Procedure in Case No. PAC-06-is Friday, November 3,2006. Also established is a Friday, November 17, 2006 deadline for reply comments. Persons desiring a hearing must specifically request a hearing in their written protest or comments. YOU ARE FURTHER NOTIFIED that the Commission has scheduled a hearing on TUESDAY. NOVEMBER 28. 2006 COMMENCING AT 9:30 A.M. AT THE COMMISSION'S HEARING ROOM. 472 WEST WASHINGTON. BOISE. YOU ARE FURTHER NOTIFIED that the Commission hereby establishes a Friday, December 1 , 2006 deadline for Petitions for Intervenor Funding. Reference Idaho Code 61-617A; IDAPA 31.01.01.161-165. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the deadline established above, the Commission may consider the matter on its merits and may enter its Order without a formal hearing. If comments or protests are filed within the deadline, the Commission will consider them and in its discretion may hold a hearing or may decide the matter and issue its Order based on the written positions before it.
