HomeMy WebLinkAbout19960708_1.docx MINUTES OF DECISION MEETING July 8, 1996 - 1:30 p.m. In attendance at this time were Commissioners Ralph Nelson, Marsha H. Smith and Dennis Hansen and staff members Birdelle Brown, Gary Richardson, Tonya Clark, Brad Purdy, Bill Eastlake, Weldon Stutzman, Scott Woodbury, Terri Carlock, Don Howell, Joe Cusick, Eileen Benner, Dave Schunke, Jim Long  and Myrna Walters. Also in attendance were Jeanette Bowman and two others from Idaho Power Company. Items from the July 8, 1996 Agenda were discussed and acted upon as follows. 1. Scott Woodbury’s July 2, 1996 Decision Memorandum re: Case No. WWP-E-96-2 Schedule 26 -- Experiment direct Access Delivery Service. (Held from July 3, 1996 Decision Meeting) Commissioner Smith said she thought it would be beneficial for the Commission to have discussions on generic restructuring before deciding to approve or deny the tariff. Propose continuing to hold this item until deliberations in generic case are over. Other two commissioners support this proposal. 2. Weldon Stutzman’s July 3, 1996 Decision Memorandum re: Case No. IPC-E-96-9, Written Comments--Idaho Power’s Request for a Declaratory Order Regarding the Leasing of dark Fiber. Question is: Should Idaho Power’s request for a declaratory Order, stating that the providing of dark fiber is not a telecommunications service, be granted? Commissioner Nelson said okay.   Commissioner Hansen asked - Idaho Power is only providing the fiber cable? Weldon said yes. Commissioner Smith said under these facts, it is not a telecommunications service provider but this does raise questions for the future on how we are going to protect USF proposals and other items bundled into telephone rate structure when we have people doing this all over. Need to think about those things. Approved. 3. Terri Carlock’s July 5, 1996 Decision Memorandum re: Idaho Power company’s Request for Accounting Order Related to Nez Perce Tribe Payments, Case No. IPC-E-96-3. Commissioner Smith asked what the difference was between what staff proposed and what company proposed? Commissioner Nelson said staff supported company.   Terri Carlock clarified that staff supported the primary filing. (Take the payment and capitalize it and begin amortizing now and make it part of the next rate case. Approved. 4. Unresolved EAS petitions  - Telephone  - Decision Memo from Joe Cusick. Commissioner Smith said he would suggest we get right on these, especially Homedale/Wilder/Parma. Commissioner Hansen asked if Commissioner Smith proposed getting involved in these before we get done with Case 96-4? Commissioner Smith replied - if they don’t get started on these now it will be a year until they can be heard. **Decision was to have them queued up. Do whatever makes sense procedurally.
