not just one segment. The interpretation of PURPA must be fair, as you know. Schwendiman
intends to operate the wind farm 11 miles northeast of Idaho Falls & to be in operation byJuly 15, 2006. Schwendiman intends to operate as a small power production facility that
qualifies for rates published under PURPA. The Schwendiman proj ect has a capacity total of
17.5 MW. Pacificorp will not pay for any more than 10 average megawatts on a monthly
basis, though it will accept any surplus energy produced beyond the 10 ave. MW. Under a
previous Commission order, proj ects can be no larger than 10 ave. MW, as I understand to
qualify for PURPA rates. That upper limit has since been lowered by you the Commission to
100 killowatts. However, the Schwendiman proj ect, was far along in its development when
the Commission changed the rules by lowering the limit. It is my request that the
Schwendiman proj ect be included under grandfathering provisions the Commission approved in
a recent order. The ones that will benefit in all of this is this is the utility customers
as this would be beneficial to those customers. Please help us make Idaho an "energy
