On August 15 , 2005, PacifiCorp filed an Application for approval of a Power
Purchase Agreement for the sale and purchase of electric energy between PacifiCorp and
Schwendiman Wind LLC ("Schwendiman
).
The Agreement is dated July 19 2005.
NOTICE OF APPLICATION
YOU ARE HEREBY NOTIFIED that under the Agreement, Schwendiman will sell
and PacifiCorp will purchase electric energy generated by the Schwendiman Wind Facility
Facility ) near Idaho Falls, Idaho. Schwendiman intends to design, construct, install, own
operate, and maintain the Facility.
YOU ARE FURTHER NOTIFIED that Schwendiman intends to operate the Facility
as a qualified small power production facility (QF) under PURP A. The wind power will not be
firmed and the Agreement is for a 20-year term.
YOU ARE FURTHER NOTIFIED that the Facility will have a nameplate capacity
rating of 17.5 megawatts (MW). Under the Agreement Schwendiman will be required to
provide certain data to PacifiCorp in order that PacifiCorp may determine whether, under normal
or average conditions, the Facility will not exceed 10 aMW on a monthly basis. Furthermore
the parties agree that should the Facility exceed 10 aMW on a monthly basis, PacifiCorp will
accept the energy but will not purchase or pay for the accepted, excess energy.
YOU ARE FURTHER NOTIFIED that the Application includes a letter from Brian
D. Jackson on behalf of the Schwendiman Wind Project. Mr. Jackson is the project engineer for
Schwendiman. His letter asserts that Schwendiman meets the grandfathering requirements from
Order No. 29839 (Case No. IPC-05-22). On August 22, 2005, Mr. Jackson sent a letter to the
Commission Staff requesting expedited treatment of the Application.

YOU ARE FURTHER NOTIFIED that the Commission has reviewed the
Application in this case and has preliminarily determined that the public interest in this matter
may not require a formal hearing to consider the issues presented. The Commission will process
this Application under Modified Procedure pursuant to its Procedural Rules 201-202, IDAP A
31.01.01.201-202. The Commission notes that Modified Procedure and written comments have
proven to be an effective means of obtaining public input and participation.
YOU ARE FURTHER NOTIFIED that the deadline for filing written comments in
support or opposition to the Application and the use of Modified Procedure in this case is
fourteen (14) days from the service date of this Order. The comment must contain a statement of
reasons supporting the comment. Persons desiring a hearing must specifically request a hearing
in their written comments. Written comments concerning this Application shall be mailed to the
Commission and the Applicant at the addresses reflected below:

YOU ARE FURTHER NOTIFIED that if no written comments or protests are
received within the time limit set, the Commission may consider the matter on its merits and may
enter its Order without a formal hearing. If written comments or protests are received within the
deadline, the Commission will consider them and in its discretion may set the matter for hearing.

YOU ARE FURTHER NOTIFIED that the Application together with supporting
workpapers and exhibits have been filed with the Commission and are available for public
inspection during regular business hours at the Commission offices. The Application is also
available on the Commission s website www.puc.idaho.gov by clicking on "File Room" and
then "Electric Cases.
YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held
pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and specifically
Idaho Code ~ 61-503 and 16 U.C. ~ 824a-3(b). The Commission may enter any final Order
consistent with its authority under Title 61.
YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be
conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq.
ORDER
IT IS HEREBY ORDERED that the Application be processed by Modified
Procedure, IDAPA 31.01.01.201 - .204. Persons interested in submitting written comments in
this matter must do so no later than fourteen (14) days from the service date of this Order.
