On November 25 , 2005 , the Commission Staff on behalf of the Joint Applicants
(MidAmerican Energy Holdings Company and PacifiCorp) and all the other parties to this case
requested that the Commission postpone the Staff/Intervenor pre file date and the Applicants
rebuttal prefile date. The Motion states that the parties believe an additional settlement
conference may be fruitful given recent settlements in the California and Utah proceedings.
Scheduling Order No. 29867 required that the Staff and Intervenors prefile their
direct testimony no later than December 6, 2005 and that the Joint Applicants file their rebuttal
testimony no later than January 6, 2006. The parties urge the Commission to suspend these
testimony deadlines and instead schedule another settlement conference to be held in Boise
December 8, 2005. The parties request that the Commission reschedule the Staff/Intervenor
testimony for December 20, 2005 and the Applicants' rebuttal testimony for January 9 , 2006.
The parties maintain that the postponement will not cause a delay in the technical hearing.
Based upon our review of the Motion and the lack of any objection, we find that
there is good cause to grant the Motion. We further find there is good cause to act on this
procedural Motion on less than 14 days notice pursuant to Rule 256, IDAP A 31.01.01.256.03.
ORDER
IT IS HEREBY ORDERED that the Motion filed by the Commission Staff on behalf
of all the parties is granted.
IT IS FURTHER ORDERED that the deadlines for filing Staff/Intervenor prefile
testimony on December 6, 2005 and Applicants' rebuttal testimony on January 6, 2006 are
postponed. Staff and Intervenors shall file their prefile testimony no later than December 20
2005. The Applicants shall file their rebuttal testimony no later than January 9, 2006.
ORDER NO. 29924
IT IS FURTHER ORDERED that another settlement conference shall be convened
on December 8, 2005 in Boise. The conference shall convene at 9:30 a.m. in the Commission
Hearing Room located at 472 West Washington Street, Boise, Idaho. Parties desiring to
participate by phone shall contact the Commission Secretary to set up the call no later than
December 6 2005.
IT IS FURTHER ORDERED that the Commission Secretary shall serve this Order
on the parties by electronic mail.
