Dear Ms. Noriyuki:
Pursuant to Commitment I 17(2), incorporated in the Idaho Public Utilities Commission
Order No. 29973, issued February 13, 2006, as supplemented by Order No. 29998 March 14,
2006, in the above-referenced proceeding, approving the acquisition of PacifiCorp by
MidAmerican Energy Holdings Company (now Berkshire Hathaway Energy Company or BHE),
PacifiCorp hereby provides notice of an affiliated interest transaction with the BNSF Railway
Company (BNSF).
PacifiCorp entered into an agreement with BNSF for a license, Electric Supply Line
Across or Along Railway Property (Permit #23W-17129) (License), allowing PacifiCorp to
construct and maintain an electric supply line containing a maximum of four new conductors,
together with its supporting or containing structures, across or along the rail corridor of BNSF at
or near the station of Umatilla, County of Umatilla, State of Oregon, Line Segment 0047, Mile
Post OPP 193.26, as shown on the attached Drawing No. 87343, dated August 1, 2023, and
included with the License as Exhibit “A”. A true copy of the License accompanies this Notice as
Attachment A.
PacifiCorp is a wholly-owned indirect subsidiary of Berkshire Hathaway Energy
Company (BHE). BHE is a subsidiary of Berkshire Hathaway Inc. BNSF is also a subsidiary of
Berkshire Hathaway Inc., thus creating an affiliated interest relationship between PacifiCorp and
BNSF.

BNSF uses standardized pricing for these types of permits. PacifiCorp will pay
$18,566.00 for the 25-year License, which includes the application fee and insurance. Obtaining
this License is in the public interest because it allows PacifiCorp to work on facilities at or near
the Umatilla station. This work is necessary to build facilities needed to serve PacifiCorp’s
customers, among them BNSF. Without the License, PacifiCorp cannot meet its obligation to
provide safe and reliable electric service. As the property owner, BNSF is the only entity that can
grant the License to PacifiCorp.
