On April 24, 2003 , Del Ray Holm (Petitioner) filed a Petition with the Idaho Public
Utilities Commission (Commission) requesting an Order requiring PacifiCorp, then doing
business as Utah Power & Light Company, (PacifiCorp; Company) to provide detailed cost data
and specifications for converting existing overhead power lines to underground lines and related
facilities. On April 29, 2003 , the Commission issued Notices of Petition and Scheduling in Case
No. PAC-03-07. On May 7 2003 , pursuant to scheduling, PacifiCorp filed its answer to the
Petition of Del Ray Holm and filed also a Motion to Dismiss. PacifiCorp contended that the
Company was complying with its electric service regulations and that it had supplied sufficient
information to the petitioner. Petitioner replied on May 16, 2003, and on May 27, 2003
requested an expedited hearing. What followed was an informal stay of proceedings and
negotiation. The Commission is informed that the matter was resolved informally.
The Commission has reviewed the filings of record in Case No. PAC-03-07. As a
matter of administrative housekeeping and because the Commission believes the underlying
dispute was resolved, we find it reasonable to dismiss the Petition of Del Ray Holm without
prejudice.
CONCLUSIONS OF LAW
The Commission has jurisdiction over PacifiCorp, now doing business as Rocky
Mountain Power and previously doing business as Utah Power & Light Company, an electric
utility, and the issues presented in Case No. P AC-03-07 pursuant to the authority and power
granted it under Title 61 of the Idaho Code and the Commission s Rules of Procedure, IDAP A
31.01.01.000 et seq.

In consideration of the foregoing and for reasons more particularly described above
IT IS HEREBY ORDERED and the Commission does hereby dismiss the Petition of Del Ray
Holm in Case No. P AC-03- 7 without prejudice and closes the case docket.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for
reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7)
days after any person has petitioned for reconsideration, any other person may cross-petition for
reconsideration. See Idaho Code ~ 61-626.
