CASE NO. P AC-O3- ORDER NO. 29193 On January 31 , 2003, PacifiCorp dba Utah Power & Light Company (PacifiCorp; Company) filed an Application with the Commission requesting approval of a proposed amended electric service Schedule 72 - Irrigation Load Control Credit Rider program. The Company in its filing requests a proposed effective date of March 3 , 2003. After reviewing the Application, we make the following Findings of Fact, Conclusions of Law and Order: FINDINGS OF FACT 1. PacifiCorp has submitted proposed changes to its electric tariff Schedule 72 to become effective on and after March 3, 2003. The Company s Application is of sufficient importance to require a reasonable amount of time for investigation and comment. 2. The Commission will be unable to consider the Company s filing in Case No. PAC-03-3 before March 3 2003, because of the time required for investigation and comment and because of other demands on the Commission s time. CONCLUSIONS OF LAW 1. The Idaho Public Utilities Commission has jurisdiction over PacifiCorp dba Utah Power & Light Company, an electric utility, and its Application in Case No. P AC-03-3 by virtue of Title 61 , Idaho Code and the Rules of Procedure of the Idaho Public Utilities Commission, IDAPA 31.01.01.000 et seq. 2. The Commission has authority under Idaho Code ~ 61-503 to investigate the reasonableness of the Company s proposed change in tariff Schedule 72 and pursuant to Section 61-622 has the authority to suspend the proposed effective date of the Company s Application for a period of thirty (30) days plus five (5) months, from the proposed effective date of March 3 2003. ORDER NO. 29193 3. It is necessary to suspend the proposed effective date of the Company s proposed change in tariff Schedule 72 for a period of ninety (90) days, or less if the Commission acts sooner, from the effective date of March 3 , 2003 , to allow the Commission sufficient time to investigate and obtain comments and to then consider and determine the issues presented in the Company s Application. ORDER IT IS THEREFORE ORDERED that the proposed changes to PacifiCorp s electric Schedule 72 should be, and hereby are, suspended for a period of ninety (90) days from March 3 2003 , or until such earlier time as the Commission may issue an Order accepting or rejecting or modifying the Application in Case No. P AC-03- DONE by Order of the Idaho Public Utilities Commission at Boise, Idaho this J. f4-. day of February 2003.
