PROCEDURAL HANDLING OF RECENT FILINGS
This matter is scheduled for hearing in eastern Idaho on May 6 (07), 2002. The Commission is advised of the following recent filings in this case:
Pursuant to Commission Notice issued April 22, 2002, the deadline for prefiling party testimony in this case, both for and against the stipulation and proposed settlement, was April 30, 2002. Instead of testimony, the intervenor, Timothy J. Shurtz, on April 30 filed a fax “request for continuance.” See attached. A notarized document entitled “written testimony of Timothy J. Shurtz” was filed on May 3, 2002. See attached.
Also filed with the Commission on April 30 were comments by NuWest Industries, Inc. The following day, on May 1, 2002, NuWest filed a Petition to Intervene (claiming the Petition is late filed as a result of excusable neglect).
Staff has represented to Tim Shurtz and NuWest that the Commission would deal with their filings most likely at the beginning of the technical hearing on May 7, 2002.
