HomeMy WebLinkAbout28947_susp.docBEFORE THE IDAHO PUBLIC UTILITIES COMMISSION IN THE MATTER OF THE APPLICATION OF PacifiCorp DBA UTAH POWER & LIGHT COMPANY FOR APPROVAL OF CHANGES TO ITS ELECTRIC SERVICE SCHEDULES. ) ) ) ) ) ) CASE NO. PAC-E-02-01 ORDER NO. 28947 On January 7, 2002, PacifiCorp dba Utah Power & Light Company (PacifiCorp; Company) filed an Application with the Idaho Public Utilities Commission (Commission) requesting approval of proposed electric service schedules. Included in the Company’s filing is a related Cost-of-Service (COS) study, a proposed Schedule 34-BPA Exchange Credit distribution, a proposed Power Cost Surcharge ($38 million) and a proposed Rate Mitigation Adjustment (RMA). The Commission by Notice issued January 15, 2002, announced its proposal to process the Company’s request for implementation of the Schedule 34-BPA Exchange Credit under Modified Procedure, i.e., by written submission rather than by hearing. Reference Commission Rules of Procedure, IDAPA 31.01.01.201-204. The Company requested that the Schedule 34-BPA Credit be approved for an effective date of February 01, 2002. The Commission found the remainder of the Company’s Application to be of such nature that the public interest requires a public hearing. Reference Order No. 28931. PacifiCorp has requested that the non-Schedule 34 changes to its electric service schedules be effective February 7, 2002. Reference PacifiCorp witness James Z. Zhang Testimony, Exhibit No. 18. The Commission finds that it will be unable to consider the remainder of the Company’s Application prior to the proposed February 07, 2002 effective date because of the complexity of issues presented, because of the procedural time required to process the Application and because of other demands on the Commission’s time. CONCLUSIONS OF LAW The Idaho Public Utilities Commission has jurisdiction over this matter by virtue of Title 61, Idaho Code. The Commission has authority under Idaho Code § 61-622 to suspend the proposed changes to the rates, charges and service schedules that are the subject of this Application for a period of thirty (30) days plus five (5) months from the proposed effective date of February 7, 2002. It is necessary to suspend the proposed changes to rates, charges and service schedules proposed in this Application for a period of thirty (30) days plus five (5) months from February 7, 2002, to allow the Commission to hear the evidence to be presented in this matter and to consider and to determine the issues presented in this Application. O R D E R IT IS THEREFORE ORDERED that the proposed changes to the Company’s electric service schedules requested in Case No. PAC-E-02-01 should be, and hereby are, suspended for a period of thirty (30) days plus five (5) months from February 7, 2002, or until the Commission issues an Order accepting, rejecting or modifying the Application in this matter.
