The City of Firth, an Idaho municipal corporation, at the scheduled February 19,
2002 prehearing conference in Case No. PAC-E-02-1, petitioned to intervene in this case
pursuant to Rules of Procedure 71 through 75 of the Idaho Public Utilities Commission, IDAPA
31.01.01.071-.075.
FINDINGS OF FACT
Pursuant to Notice issued January 16, 2002, an intervention deadline of February 8,
2002 was established in Case No. PAC-E-02-1. Although the Intervention Petition of Firth is
untimely, we find that no party at the prehearing conference opposed its Petition to Intervene.
We further find, based on the representations of Timothy Shurtz, Firth City
Councilman, that intervention by this party will not unduly broaden the issues in this case and
will serve the purposes of intervention as described by Rule 74 of the Rules of Procedure and
should be granted.
O R D E R
IT IS THEREFORE ORDERED that the Petition to Intervene of the City of Firth is
hereby granted.
IT IS FURTHER ORDERED that all parties in this proceeding serve all papers
hereafter filed in this matter on all parties of record. This Intervenor is represented by the
