Pursuant to IPUCRP 164, PacifiCorp, dba Utah Power & Light Company
PacifiCorp" or the "Company ) opposes the application of Timothy J. Shurtz for
intervenor funding, and in support of that opposition states as follows:
Commission Rule of Procedure 165 requires that for a party to obtain
intervenor funding in a case, the party must make a material contribution to the
Commission s decision. Indeed, if the Commission is to award funding to an intervenor
it must make a specific finding that the intervenor made a material contribution to the
Commission s decision. IPUCRP 165. Such a finding cannot be made in this case if the

Commission approves the Stipulation filed on April 11 , 2002, because Mr. Shurtz
testimony and argument in the case was in opposition to the Stipulation. Under such
circumstances, intervenor funding cannot be awarded to Mr. Shurtz.
Even if the Commission were to award intervenor funding to Mr. Shurtz, it
should review the reasonableness of the amounts claimed and make adjustments to
disallow unreasonable amounts. For instance, Mr. Shurtz seeks reimbursement, at $40
per hour, for 4 hours spent locating legal counsel.
