PAC-E-01-9 JOINT NOTICE OF APPLICATION JOINT NOTICE OF MODIFIED PROCEDURE ORDER NO. 28749 On May 18, 2001, Idaho Power Company filed an Application requesting Commission authorization to discontinue the filing of the annual cost information-unbundling report (“cost report”). Idaho Power also requests suspension of the July 1, 2001 filing date for this cost report until the Commission makes a decision on its Application. On June 5, 2001, Avista Corporation dba Avista Utilities filed a Motion for an Extension of the Filing Date with respect to the same unbundled cost report. On June 8, 2001, PacifiCorp filed an Application identical to Idaho Power Company’s request. The Companies have made their requests based on the fact that Idaho Code §§ 61-338 and 61-339 became null and void and of no force and effect on and after January 1, 1999. See Compiler’s notes to §§ 61-338 and 61-339. In the event that the Commission does not grant the Companies’ requests PacifiCorp, in the alternative, asks the Commission to extend the annual filing date for the cost report until October 1 of each year. The Companies request that their Applications be processed by using Modified Procedure under the Commission’s Rules. IDAPA 31.01.01.201-.204. YOU ARE HEREBY NOTIFIED that the Applications have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices and at the offices of the Companies in these cases. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has reviewed the filings of record in Case Nos. IPC-E-01-18, AVU-E-01-9, and PAC-E-01-9. The Commission has preliminarily determined that the public interest may not require a hearing to consider the issues presented and that the issues raised by the Applications may be processed under Modified Procedure, i.e., by written submission rather than by hearing. See, IDAPA 31.01.01.201-.204. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on these Applications may file a written comment in support or opposition with the Commission within twenty-one (21) days of the service date of this Order, not including the day this Order was issued. IDAPA 31.01.01.017. All comments should contain the case caption and case numbers shown on the first page of this document. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the deadline, the Commission will consider these Applications on their merits and enter Orders without a formal hearing. If comments or protests are filed within the deadline, the Commission will consider them and in its discretion may set the matter for hearing or may decide the matter and issue its Order on the basis of the written positions before it. Any person desiring to state a position on Idaho Power’s, Avista’s or PacifiCorp’s Application may file a written comment in support of or in opposition to the Companies’ requests. These comments must be filed within twenty-one (21) days of the date of this Order. IT IS FURTHER ORDERED that reply comments shall be filed on or before seven (7) days after conclusion of the twenty-one (21) days written comment period above. IT IS FURTHER ORDERED that the July 1, 2001 filing date for the cost reports of the Companies is hereby suspended for sixty (60) days from July 1, 2001, or until the Commission issues a further order determining the issues in these cases.
