On August 2, 2001, the Commission issued a Notice of Hearing for Oral Argument on a Motion to Dismiss filed by Snake River Valley Electric Association (Snake River). Snake River’s Motion asked the Commission to dismiss a petition filed by PacifiCorp pursuant to Idaho Code § 61-332D. Since the Notice was issued by the Commission, the parties have filed other motions, necessitating vacating the original oral argument date. The date for oral argument is rescheduled for September 28, 2001.
PacifiCorp filed a Motion for Summary Judgment on August 15, 2001. PacifiCorp asked that oral argument on its Motion for Summary Judgment be heard during the oral argument scheduled for September 5, 2001. Under the Commission’s Rules of Procedure, Snake River may take up to two weeks to respond to the motion filed by PacifiCorp. See IPUC Rule of Procedure 57.03; IDAPA 31.01.01.057.03. However, Snake River filed a motion asking for additional time - until September 17, 2001 - to respond to PacifiCorp’s Motion to Dismiss. The Commission has determined to grant Snake River’s Motion for additional time to respond to the Motion for Summary Judgment, and also to hear argument on the Motion to Dismiss and Motion for Summary Judgment in one hearing. It is therefore necessary to vacate the oral argument hearing scheduled for September 5, 2001. The Commission will hear oral argument on Snake River’s Motion to Dismiss and PacifiCorp’s Motion for Summary Judgment at a single hearing to be held September 28, 2001.
YOU ARE HEREBY NOTIFIED that the oral argument set for September 5, 2001 is vacated. The Commission will hear oral argument on Snake River’s Motion to Dismiss on SEPTEMBER 28, 2001 AT 9:30 A.M. AT THE COMMISSION HEARING ROOM, 472 W. WASHINGTON, BOISE, IDAHO.
YOU ARE FURTHER NOTIFIED that the Commission will hear oral argument on PacifiCorp’s Motion for Summary Judgment on SEPTEMBER 28, 2001 AT 9:30 A.M. AT THE COMMISSION HEARING ROOM, 472 W. WASHINGTON, BOISE, IDAHO.
YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act. In order to participate and understand testimony and argument at a public hearing, persons needing the help of a sign language interpreter or other assistance may ask the Commission to provide a sign language interpreter or other assistance as required under the Americans with Disabilities Act. The request for assistance must be received at least five (5) working days before the hearing by contacting the Commission Secretary at:

IT IS HEREBY ORDERED that the oral argument hearing set for September 5, 2001 is vacated and is rescheduled for September 28, 2001 at 9:30 a.m. The Commission will hear argument on Snake River’s Motion to Dismiss and PacifiCorp’s Motion for Summary Judgment on September 28, 2001 at 9:30 a.m.
IT IS FURTHER ORDERED that the motion by Snake River for additional time in which to respond to PacifiCorp’s Motion for Summary Judgment is hereby granted. The time for which Snake River may respond to PacifiCorp’s Motion is extended to September 17, 2001. PacifiCorp may file a reply no later than September 24, 2001.
