NOTICE OF HEARING FOR ORAL ARGUMENT
This case was opened on April 13, 2001, when PacifiCorp doing business as Utah Power & Light Company (PacifiCorp) filed a petition “for a review of PacifiCorp’s action in response to a request by Snake River Valley Electric Association (SRVEA) for certain wheeling service, and for an Order determining that PacifiCorp shall not be required to provide such wheeling service.” Petition p. 1. PacifiCorp’s petition was filed pursuant to Idaho Code § 61-332D(2) which provides that “an electric supplier declining to provide wheeling service pursuant to this section shall petition the Commission for review of the electric supplier’s actions in respect to a request for such service.” In lieu of an answer filed at the Commission, SRVEA filed a Notice of Removal of State (IPUC) Case No. PAC-E-01-6 in the United States District Court for the District of Idaho on May 7, 2001. Several motions were thereafter filed with the District Court, including a Motion to Intervene by the Idaho State Attorney General’s Office and a Motion to Remand to the IPUC filed by PacifiCorp. Following oral argument on June 27, 2001, the District Court granted the State’s Motion to Intervene as well as the Motion to Remand. The District Court entered a judgment on June 29, 2001, formally granting the Motion to Remand and directing the Clerk of the Court “to take the steps necessary to remand this action to the Idaho Public Utilities Commission.”
On July 9, 2001, SRVEA filed a Motion to Dismiss PacifiCorp’s Petition. PacifiCorp filed its answer to SRVEA’s Motion on July 20, 2001, and requested oral argument. An answer to the Motion to Dismiss also was filed by the Idaho Attorney General’s Office. The Commission has determined to schedule an oral argument on SRVEA’s Motion to Dismiss for September 5, 2001.
YOU ARE HEREBY NOTIFIED that the Commission will convene a hearing for oral argument on SRVEA’s Motion to Dismiss on SEPTEMBER 5, 2001 AT 10:00 A.M. AT THE COMMISSION’S HEARING ROOM, 472 WEST WASHINGTON, BOISE, IDAHO.
YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act. In order to participate, understand testimony and argument at a public hearing, persons needing the help of a sign language interpreter or other assistance may ask the Commission to provide a sign language interpreter or other assistance as required under the Americans with Disabilities Act. The request for assistance must be received at least five (5) working days before the hearing by contacting the Commission Secretary at:
