HomeMy WebLinkAbout19950522_1.docx MINUTES OF MAY 22, 1995 DECISION MEETING 1:30 p.m. In attendance at this time were:  Commissioners Ralph Nelson, Marsha H. Smith and Dennis Hansen and staff members Don Howell, Scott Woodbury, Tonya Clark, Treva Pline, Randy Lobb, Madonna Faunce, Syd Lansing, Terri Carlock, Rick Sterling and Chris Maschmann.  Also in attendance were:  Mike McGrath and Skip Worthen of Intermountain Gas Company. Items from the May 22, 1995 Agenda were discussed and acted upon as follows. 1.  Regulated Carrier Division Agenda dated May 22, 1995. Commissioner Smith made motion to approve all matters on RCD agenda. Commissioner Hansen seconded the motion and Commissioner Nelson concurred. 2.  Don Howell’s May 18, 1995 Decision Memorandum re:  Formal Complaint against Union Pacific concerning the Weiser-Payette Freight Agency, Case No. UP-RR-94-5. Commissioner Nelson asked if this should be included in the consolidation case. Commissioner Smith said she would move that the complaint should be dismissed. Commissioner Hansen seconded the motion.  Commissioner Nelson concurred. 3.  Scott Woodbury’s May 12, 1995 Decision Memorandum re:  Case No. IPC-E-94-24 Auger Falls Petition for Reconsideration (held from May 15, 1995 Decision Meeting). Commissioner Nelson suggested that this be moved to fully submitted matters and taken up after the Decision Meeting. Commissioner Smith and Commissioner Hansen agreed. 4.  Scott Woodbury's May 17, 1995 Decision Memorandum re:  Case No. INT-G-95-2  App to defer NW Pipeline system Expansion II termination costs and demand charge credits. Commissioner Nelson asked if there was anyone who had any discussion on this item. Commissioner Smith said yes the Commission continues to find Modified Procedure in this case to be appropriate, yes the Commission finds the Company’s decision to terminate its participation in NWP’s Expansion II to be reasonable and prudent and yes the Company’s Application for Authority to defer NWP System Expansion II termination costs and demand charge credits should be approved. Commissioner Hansen and Commissioner Nelson concurred. 5.  Scott Woodbury's May 17, 1995 Decision Memorandum re:  Case No. INT-G-95-1 Purchased Gas Cost Adjustment. Commissioner Nelson asked if this should be on Modified Procedure. Commissioner Smith reminded him that it was already on Modified Procedure.   All Commissioners agreed that Modified Procedure was appropriate and approved the Purchased Gas cost Adjustment tariff language. 6.  Scott Woodbury’s May 18, 1995 Decision Memorandum re:  Case No. SVE-G-95-1 Certificate Application of Star Valley Energy, Inc. Commissioner Smith asked if there was any response to comments. Scott Woodbury said there has been no response.  Gary Richardson issued a press release to the Idaho Falls paper but nobody responded.  Essentially staff felt that the application did not have enough information for the Commission to make a determination of viability.  There are a number of options - overlooking the deficiencies and granting the application, outright denying, staying further action pending the Company provide further evidence of liability or set up a show cause hearing. Commissioner Nelson asked if we could write the Company a letter saying we are holding the application until we receive further information. Commissioner Hansen said there were a lot of unanswered questions and NW needs to provide the Commission with more information. Commissioner Smith said she saw two options.  1) return the application saying it was deficient or 2) ask Star Valley to respond with more information for the Commission to make a decision. The decision was made to ask the Company to respond to Staff Comments on the deficiencies they had pointed out.   7.  Terri Carlock’s May 19, 1995 Decision Memorandum re:  Pacificorp’s Request for Authority to Issue up to $125,000,000 of Pollution Control Revenue Bonds, PAC-S-95-2. Commissioner Nelson said it looked ok to him. Commissioner Smith made motion for approval. Commissioner Hansen seconded it. Meeting adjourned. Dated at Boise, Idaho, this 22nd day of May, 1995.
