IPC-93- PETITION FOR APPROVAL OF SETTLEMENT AND STAY OF PROCEDURAL SCHEDULE COMES NOW The New Villager Condominium Association , Inc., a non- profit Idaho corporation and its members individually ("New Villager"), by and through its attorney of record , John F. Kurtz, Jr., of the firm of Hawley Troxell Ennis & Hawley, Respondent, and Idaho Power Company ("Idaho Power" or the "Company ), by and PETITION REQUESTING APPROVAL OF SETTLEMENT AND STAY OF PROCEDURAL SCHEDULE, Page through its attorney of record , Larry D. Ripley, Senior Attorney for Idaho Power Company, Petitioner, and herewith jointly petition the Commission for an Order approving the attached settlement agreement between the parties. Due to the necessity of completing the actual work in the spring or fall of 2004, the parties also request that the Commission issue its Order staying its Procedural Order No. 29366 until notified that either the provisions of the settlement agreement have been completed or that the parties have been unable to agree as to resolution of one of the provisions set forth in the settlement agreement. Idaho Power submits that resolution of this dispute will not only resolve this longstanding dispute, but is also in the public interest in that it will provide Idaho Power with information necessary for Idaho Power to make a future determination as to whether it is feasible to provide underground/ submersible transformer residential service in other parts of its service territory in the state of Idaho.
