MINUTES OF DECISION MEETING - November 28, 1994 - 1:30 p.m.
In attendance at this time were Commissioners Marsha H. Smith and Ralph Nelson.  Commissioner Joe Miller was excused.  Staff members in attendance were Mary Friddle, Scott Woodbury, gary Richardson, Stephanie Miller and Myrna Walters.  
Items from the November 28, 1994 Decision Meeting Agenda were discussed and acted upon as follows.
1.  Regulated Carrier Division Agenda dated November 28, 1994.
Approved.
2.  Don Howell's November 25, 1994 Decision Memorandum re:  TCIU Formal Complaint Against UP concerning the Montpelier and Soda Springs Freight Agencies, Case No. UP-RR-94-4.
Decision was to send summons to the RR and to assign it a new case number.
3.  Consent Agreement in WWP-E-94-5 - Line Extension Tariff 51.
Commissioner Nelson commented he didn't see how the Commission could do any beter with a hearing.
Commissioner Smith said the question she had was - what do we do now?  What is the process?  Suggested putting out a proposed order vacating the current hearing, adopt the consent agreement as a rull resolution of the matter and propose to dispose of the case.  Give people 14 days to comment.
Scott Woodbury said he thought the Commission could adopt the agreement and do an order now.
Commissioner Smith said she wanted to be cautious.  Further filings by staff and WWP are not necessary but others could put in information.
Decision was to not speak specifically to Peter Richardson's filing in this case.
**Will accept written comments to the proposed order.
