BACKGROUND On November 7,2023,Idaho Power Company ("Company"),applied for approval of the Second Amendment to its 2022 Special Contract for Electric Service Between Idaho Power Company and Micron Technology,Inc.("Second Amendment").An updated version of the Company's Schedule 26 changing the date of the Amended Special Contract accompanied the Application as an attachment. The Company entered into a revised Special Contract for electric service with Micron Technology,Inc.("Micron")in March of 2022 to replace one that had been in effect since 2009. In August of 2023,the Commission approved the first amendment to the 2022 Special Contract, STAFF COMMENTS 1 DECEMBER 20,2023 which modified the Special Contract to address certain issues the Commission identified in Case No.IPC-E-22-06. The Second Amendment proposed in this Application extends the annual deadline for retiring environmental attributes connected with project output from January 316'to March 161. The Company states that the parties to the Special Contract seek this extension because of the logistics of retiring such attributes. STAFF ANALYSIS Staff reviewed the Company's proposed Second Amendment and recommends the Commission approve it.This recommendation is based on Staff s review of the Application and a determination that the Second Amendment will not materially change Micron's Special Contract or impact other customers. Staff s review of the Application focused on identifying whether the Second Amendment would materially change Micron's Special Contract or impact other customers.Staff believes changing the annual deadline for retiring environmental attributes from January 316'to March P' does not materiallychange the Special Contract.Additionally,Staff did not identify any impacts to other customers caused by the change to the annual deadline. In the Application,the Company provided a copy of the Second Amendment as Attachment 1,and an updated Schedule 26 as Attachment 2.Staff reviewed both Attachments and believes they adequatelyaddress the changes needed to amend the Special Contract as proposed in the Application.Staff recommends the Commission approve the Second Amendment and updated Schedule 26,as filed.
