HomeMy WebLinkAbout20230606Decision Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: MICHAEL DUVAL DEPUTY ATTORNEY GENERAL DATE: JUNE 6, 2023 SUBJECT: IN THE MATTER OF IDAHO POWER COMPANY’S APPLICATION FOR APPROVAL OF A SPECIAL CONTRACT UNDER TARIFF SCHEDULE 34 TO PROVIDE ELECTRIC SERVICE TO LAMB WESTON, INC.; CASE NO. IPC-E-23-18. On May 23, 2023, Idaho Power Company (“Company”) applied to the Idaho Public Utilities Commission (“Commission”) for an Order approving a special contract under Schedule 34 between the Company and Lamb Weston, Inc. (“Lamb Weston”) (the Company and Lamb Weston referred to collectively as “the Parties”). On or about August 25, 2022, the Company informed Lamb Weston that Lamb Weston could not be serviced under Schedule 19 once the power consumption for the premises exceeded 20,000 kilowatts (“kW”). At that time, Lamb Weston informed the Company that Lamb Weston expected to exceed 20,000 kW as soon as July of 2023. The Company states that the Parties then came to an agreement and filed this case as soon as possible. The Company states that it understands that it is not reasonable for the Commission to issue an order in this case before July of 2023. Should Lamb Weston consume more than 20,000 kW before a final order is issued in this case, the Company states that it will continue to provide Lamb Weston with power under Schedule 19’s rates unless the Company hears otherwise from the Commission. The Company asks the Commission to process the Application by Modified Procedure. STAFF RECOMMENDATION Staff recommends the Commission issue a Notice of Application and Notice of Modified Procedure establishing a public comment deadline of August 15, 2023, and a Company reply deadline of August 22, 2023.
