ORDER NO. 35959

On May 23, 2023, Idaho Power Company (“Company”) applied (“Application”)1 to the
Idaho Public Utilities Commission (“Commission”) for an Order approving a special contract
under Schedule 34 between the Company and Lamb Weston, Inc.
On June 23, 2023, the Commission issued a Notice of Application and Notice of Modified
Procedure and set deadlines for public and Commission Staff (“Staff”) comments and the
Company’s reply. Order No. 35822. Staff filed comments to which the Company replied. No other
comments were received.
On September 21, 2023, the Commission issued Order No. 35929 approving the
Company’s Application. Order No. 35929.
On September 28, 2023, the Company submitted a compliance filing with specific
clarifying data related to Schedule 34 and asserted that it had complied with Order No. 35929
(“Compliance Filing”).
At the Commission’s October 10, 2023, Decision Meeting, Staff presented a Decision
Memorandum which noted that Staff had reviewed the Company’s Compliance Filing and
recommended the Commission issue an Order specifying that the Company had fully complied
with Order No. 35929.
COMMISSION FINDINGS AND DECISION
The Commission has jurisdiction over this matter under Idaho Code §§ 61-501, -502, and-
503. The Commission is empowered to investigate rates, charges, rules, regulations, practices, and
contracts of public utilities and to determine whether they are just, reasonable, preferential,
discriminatory, or in violation of any provision of law, and to fix the same by order. Idaho Code
§§ 61-502 and -503.

After reviewing the Company’s Compliance Filing and Staff’s subsequent
recommendation, we are satisfied with the data provided by the Company. The Compliance Filing
fully complies with the Commission’s requirements in Order No. 35929. Therefore, the
Commission approves the Company’s Schedule 34, effective as of September 21, 2023.
ORDER
IT IS HEREBY ORDERED that the Company’s Compliance Filing is accepted, as filed,
effective as of September 21, 2023.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for
reconsideration within twenty-one (21) days of the service date of this order about any matter
decided in this Order. Within seven (7) days after any person has petitioned for reconsideration,
any other person may cross-petition for reconsideration. Idaho Code § 61-626.
