HomeMy WebLinkAbout19940926_1.docx Minutes of Decision Meeting September 26, 1994 - 1:30 p.m. In attendance at this time were Commissioners Marsha H. Smith, Joe Miller and Ralph Nelson and staff members Scott Woodbury, Lori Mann, Weldon Stutzman, Mary Friddle, Birdelle Brown, Randy Lobb, Tonya Clark, Madonna Faunce and Chris Maschmann.  Also in attendance were Jeanette Bowman, Idaho Power and Jim Wozniak, US West. Items from the September 26, 1994 Agenda were discussed and acted upon as follows. 1.  Regulated Carrier Division Agenda dated September 26, 1994. Commissioner Miller moved for approval.  The other commissioners concurred. 2.  Don Howell’s September 22, 1994 Decision Memorandum re:  Abandonment of the Scoville Branch, Case No. UP-RR-89-4 Commissioner Smith commented there is not enough business on the branch. The Commission did not find that the abandonment of this branch would be adverse to Idaho shippers and that the line does not have a potential for profitability. 3.  Birdelle Brown’s September 8, 1994 Decision Memorandum re:  US West Advice 94-06-S to Change the Name of “Information Service Access Restriction” to “Pay Per Call Restriction”. Commissioners Smith, Miller and Nelson agree with staff’s recommendation for approval to change the name. 4.  Birdelle Brown's September 23, 1994 DecisionMemorandum re:   U S West Advice 94-05-S Removing Services and Universal Service Order Codes (USOCS) for Unavailable and/or Unused Services, Effective September 30, 1994. Approved by Commissioner Smith, Commissioner Miller and Commissioner Nelson. 5.  Scott Woodbury's September 19, 1994 Decision Memorandum re:  Case No. IPC-E-94-15 Ravenscroft-Malad River Hydro Project Power Sales Agreement--Third Amendment. Approved Application and Third Amendment by Minute Entry. 6.  Scott Woodbury's September 19, 1994 Decision Memorandum re:  Case No. IPC-E-94-14 Geo-Bon II Hydroelectric Project Firm Energy Sales Agreement--First Amendment. Commissioner Nelson asked how much is there for allowing security provisions?  Has there been any discussion of it? Scott Woodbury - Yes, I discussed it with Randy Lobb and he thought the change was significant.  The company had greater confidence in the new developer. Commissioner Nelson asked if they submitted a financial statement. Scott Woodbury answered no, just the company saying trust me. Commissioner Nelson stated his concerns are setting a precedent.  A lot of developers are substantial, if they all start asking for exception... Scott Woodbury said this is an older contract.  I think the security they’re providing here is greater than the security terms under the original contract. Commissioner Nelson said if the security provisions were greater then the insurance deductible amounts were acceptable with him.  The other Commissioners concurred. Decision was made to approve with a minute entry. 7.  Weldon Stutzman's September 23, 1994 Decision Memorandum re:  Application of Intermountain Gas Company for Approval of Gas Service Agreement with Amalgamted Sugar Company. Commissioner asked if it had been 2 years since it was last extended. Madonna Faunce answered yes. The Commissioners approved the two year contract extension. 8.  Weldon Stutzman's September 22, 1994 Decision Memorandum re:  Case No. IPC-E-94-18; Idaho Power’s Application for Approval of Contract with U S Air Force to Construct Photovoltaic System. Commissioner Smith asked why they even need this. Weldon Stutzman said he thought it was under Commission authority to approve contracts. Commissioner Miller said what do they ask for? Weldon Stutzman - Just approval of the Commission. Commissioner Miller - Approval of ratemaking? Commissioner Smith - The Defense should be paying, so no Commission approval needed. The Decision was made to hold this agenda item until the next decision meeting. Meeting adjourned. Dated at Boise, Idaho, this 26th day of September, 1994.
