Chinden Boulevard Building 8, Suite 201-A Boise, Idaho 83714 Re: Case No. IPC-E-23-14 – Withdrawal of Supplemental Compliance Filing Application for Authority to Implement Changes to the Compensation Structure Applicable to Customer On-Site Generation Under Schedules 6, 8, and 84 and to Establish an Export Credit Rate Methodology Dear Commission Secretary: On Friday, December 29, 2023, (“Idaho Power” or “Company”) filed an initial Compliance Filing pursuant to Idaho Public Utilities Commission (“Commission”) Order Nos. 36042 (IPC- E-23-11), 36048 (IPC-E-23-14), and 36036 (IPCE-23-28) with tariff sheets that would become effective January 1, 2024, in compliance with those orders. Specifically with regard to Order No. 36048 in Case No. IPC-E-23-14, the Company noted that it was evaluating additional tariff modifications that may be necessary to effectuate Order No. 36048 and intended to make a second compliance filing to that end. Thereafter, on Tuesday, January 2, 2024, the Company submitted a Supplemental Compliance Filing, which was intended to reflect the directives in Order No. 36048, and included clean and legislative format Schedules 6, 8, 68, and 84 in their entirety to replace what was filed in the initial Compliance Filing dated December 29, 2023. In subsequent discussions with Staff, the Company became aware that there are further changes that need to be incorporated into the referenced schedules to ensure compliance with Commission orders. Accordingly, the Company respectfully requests that the Supplemental Compliance Filing submitted on January 2, 2024, be withdrawn from Case Nos. IPC-23-11, IPC-E-23- 14, and IPC-E-23-28. The Company is extremely appreciative of Staff’s thorough review of the draft tariff schedules and believes this approach is preferred to limit the potential for customer confusion. The Company will continue to work with Staff to identify all revisions necessary to fully comply with the Commission’s orders and will submit its compliance filing after it has done so.
