HomeMy WebLinkAbout20230823Intervention_Order_No_35902.pdfORDER NO. 35902 1 Service Date August 23, 2023 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On August 3, 2023, Walmart, Inc. (“Walmart”) filed a late petition (“Petition”) to intervene in this case. No party opposed Walmart’s petition. Having reviewed the Petition and the record, we grant Walmart’s Petition. COMMISSION FINDINGS AND DECISIONS Commission Order No. 35825 set a July 14, 2023, deadline for petitions to intervene. Walmart filed its Petition on August 3, 2023. Thus, Walmart’s Petition is untimely. Untimely petitions to intervene are governed by Commission Rules of Procedure 71-75, which provide that late petitioners must state a substantial reason for delay and good cause for untimely filing. IDAPA 31.01.01.071-.075. In its Petition, Walmart asserted it was not able to timely respond to Idaho Power’s Application due to Walmart’s internal review process. Walmart represented that after reviewing the Application Walmart decided it would be in its best interest to intervene in this case. Walmart represented that its intervention will not prejudice any parties or cause delay. Based upon our review of the Petition and the record, we find that Walmart has shown good cause for the untimely filing, and that it has a direct and substantial interest in this proceeding and will not unduly broaden the issues. We thus find it reasonable to grant Walmart’s Petition. Pursuant to Rule 73 Walmart is bound by all prior orders and notices issued in the case. O R D E R IT IS THEREFORE ORDERED that Walmart’s petition to intervene is granted. IT IS FURTHER ORDERED that all parties in this proceeding serve all papers hereafter filed in this matter on all parties of record.
