SUBJECT: IN THE MATTER OF IDAHO POWER COMPANY’S APPLICATION FOR
A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO
ACQUIRE RESOURCES TO BE ONLINE BY 2024 AND FOR APPROVAL
OF A POWER PURCHASE AGREEMENT WITH FRANKLIN SOLAR
LLC; CASE NO. IPC-E-23-05.
On February 17, 2023, Idaho Power Company (“Company”) filed an application
(“Application”) with the Idaho Public Utilities Commission (“Commission”) requesting an order:
(1) granting the Company a Certificate of Public Convenience and Necessity (“CPCN”) to acquire
72 megawatts (“MW”) of dispatchable energy storage to meet an identified capacity deficiency in
2024; and (2) approving the 25-year Power Purchase Agreement (“PPA”) between Idaho Power
and Franklin Solar LLC (“Franklin Solar”).
On March 10, 2023, the Commission issued a Notice of Application and Notice of
Intervention Deadline. Order No. 35701. Subsequently, the Commission granted intervention to
the city of Boise City. Order No. 35732.
On April 28, 2023, the Commission issued a Notice of Modified Procedure establishing a
written comment deadline of July 18, 2023, and a Company reply comment deadline of August 1,
2023. Order No. 35753.
REQUEST TO MODIFY SCHEDULE
Based upon discovery responses Staff believes that more time is required to collect and
analyze all necessary information before providing comments. Staff has conferred with the
Company, and the Company has agreed to an extension of the comment deadlines. Staff requests

that the Commission modify the currently scheduled written comment deadlines from July 18 and
August 1, 2023, to August 8 and August 15, 2023, respectively.
COMMISSION DECISION
Does the Commission wish to modify the current procedural schedule, and establish
an August 8, 2023, Staff and Intervenor comment deadline, and an August 15, 2023, Company
reply comment deadline?
