IPC-E-22-30 ORDER NO. 35925 On December 28, 2022, Idaho Power Company (“Company”) applied to the Idaho Public Utilities Commission (“Commission”) for an order (1) establishing a compensation rate of $0.0734 per kilowatt (“kW”) per hour of interruption for Large General Service Rates under Schedule 20, and $0.0835 per kW per hour of interruption for Large Power Service Rates or, in the alternative, (2) deferring implementation of a compensation structure for the mandatory interruption requirement of Schedule 20 until evaluation of cost assignment responsibility for Schedule 20 was completed in a general rate case. On August 14, 2023, the Commission issued Order No. 35888 approving the Company’s Application but noted that additional data was needed before appropriate compensation could be determined under Schedule 20. On August 15, 2023, the Company submitted a Compliance Filing with specific data related to Schedule 20; the Company asserted that it had complied with Order No. 35888. At the Commission’s August 29, 2023, Decision Meeting, the Commission Staff (“Staff”) presented a Decision Memorandum which noted that Staff had reviewed the Company’s Compliance Filing and recommended approval of the Company’s request as updated with the data from the Company’s Compliance Filing. COMMISSION FINDINGS AND DECISION The Commission has jurisdiction over this matter under Idaho Code §§ 61-501, -502, and- 503. The Commission is empowered to investigate rates, charges, rules, regulations, practices, and contracts of public utilities and to determine whether they are just, reasonable, preferential, discriminatory, or in violation of any provision of law, and to fix the same by order. Idaho Code §§ 61-502 and -503. ORDER NO. 35925 2 After reviewing the Company’s August 15, 2023, Compliance Filing, and Staff’s subsequent recommendation, we are satisfied with the data provided by the Company. The Compliance Filing addresses the Commission’s findings in Order No. 35888. Therefore, the Commission approves the Company’s Schedule 20 Original Sheet No. 20-8 as filed, effective as of August 14, 2023. ORDER IT IS HEREBY ORDERED that the Company’s compliance filing is accepted, as filed, effective as of August 14, 2023. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this order about any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. Idaho Code § 61-626.
