ORDER NO. 35448

On June 15, 2022, the Idaho Conservation League (“ICL”) moved the Idaho Public
Utilities Commission (“Commission”), under Commission Rule of Procedure 43.031 and Idaho
Bar Commission Rule (“IBCR”) 227, for an Order approving the limited admission, pro hac vice,
of Emma Sperry in this matter. The Motion was signed and attested to by local counsel Marie
Callaway Kellner of Boise, Idaho (Idaho State Bar License No. 8470).
In the Motion, Ms. Sperry certifies that she is an active member in good standing of the
Indiana State Bar. She further declares that she is not licensed to practice law in Idaho.
Ms. Sperry and Ms. Kellner certify that a copy of the Motion has been served on all
other parties to this case, and that a copy of the Motion, accompanied by a $325 fee and certificate
of good standing, have been submitted to the Idaho State Bar. Ms. Kellner acknowledges that her
attendance shall be required at all Commission proceedings in which Ms. Sperry appears, unless
specifically excused by the Commission.
COMMISSION FINDINGS
The Commission has reviewed and considered the Motion and applicable rules,
including IBCR 227 and Commission Rules of Procedure 19 and 43.03, IDAPA 31.01.01.019 and
043.03. Based on the filings of record and certified representations of Ms. Sperry and Ms. Kellner,
we find that reasonable grounds have been demonstrated to justify the granting of limited
admission of Ms. Sperry as legal counsel for ICL in this matter. We further find good reason to
excuse the appearance of Ms. Kellner in further proceedings in this docket unless needed by Ms.
Sperry.

CONCLUSIONS OF LAW
The Commission has jurisdiction in this case and over this Motion pursuant to Idaho
Code, Title 61, and the Commission’s Rules of Procedure, 31.01.01.000 et seq.
O R D E R
IT IS HEREBY ORDERED that the Motion is granted; Emma Sperry is hereby granted
limited admission as legal counsel for ICL.
IT IS FURTHER ORDERED that the attendance of Marie Callaway Kellner is excused
from all further proceedings in Case No. IPC-E-22-13 unless needed by Emma Sperry.
