IPC-E-22-01 NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE ORDER NO. 35309 On December 28, 2021, Idaho Power Company (“Company”) filed Tariff Advice No. 21-03 (“Tariff Advice”) proposing an update to the Substation Allowance outlined in Schedule 19, Large Power Service, as required by Idaho Public Utilities Commission Order Nos. 32893 and 32914. The Company requested the update to the allowance become effective February 1, 2022. Due to the significant proposed increase to the allowance amount and changes to overhead rates, Staff recommended that the Commission treat the Tariff Advice as an Application and process the case by Modified Procedure to allow additional time to review the Company’s proposal and for public input. The Commission now issues this Notice of Application, Notice of Modified Procedure, and Notice of Suspension of Proposed Effective Date. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Commission will treat the Company’s filing as an Application rather than a tariff advice. See Commission Rule of Procedure 134.02. YOU ARE FURTHER NOTIFIED that the updated Substation Allowance reflects updated material costs, labor rates, and the stations’ overhead rate. The Substation Allowance amount increased from $49,016 to $57,640—an increase of 17.6 percent. YOU ARE FURTHER NOTIFIED that the primary driver for the increase of the Substation Allowance is attributed to the increased costs of the 138kV/13.09kV, 44.8 MVA transformer, and the 4-unit metalclad switchgear—approximately 17 percent and 25 percent NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE ORDER NO. 35309 2 respectively. Other material costs generally increased but were partially offset by a decrease in the general overhead rate from 8.97 percent to 8.63 percent. YOU ARE FURTHER NOTIFIED that the Company’s Application includes the proposed tariff sheet in clean and legislative form. YOU ARE FURTHER NOTIFIED that the Application and proposed tariff sheet have been filed with the Commission and are available for public inspection during regular business hours at the Commission’s office. The Application is also available on the Commission’s website at www.puc.idaho.gov. Click on the “File Room” tab at the top of the page, scroll down to “Open Electric Cases,” and then click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code. The Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Commission’s Rules of Procedure, IDAPA 31.01.01.201 through .204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this Application may file a written comment explaining why the person supports or opposes the Application. Persons who would like a hearing must specifically request a hearing in their written comments. Interested persons must file written comments within 21 days of the service date of this Order. Comments must be filed through the Commission’s website or by email unless computer access is unavailable. To comment electronically, please access the Commission’s website at www.puc.idaho.gov. Click the “Consumers” tab and then “Case Comment Form” and complete the form using the case number as it appears on the front of this document. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE YOU ARE FURTHER NOTIFIED that the Company’s Application proposes a February 1, 2022, effective date. The proposed Substation Allowance increase is significant enough to warrant the Commission, parties, and public having a longer period to assess the Company’s Application. The Commission thus finds it appropriate to suspend the Company’s proposed effective date until March 15, 2022, unless the Commission issues an earlier order accepting, rejecting, or modifying the Company’s Application. See also Idaho Code § 61-622(4). O R D E R IT IS HEREBY ORDERED that the Commission will treat the Company’s Tariff Advice as an Application. See Commission Rule of Procedure 134.02. IT IS FURTHER ORDERED that this Application be processed under Modified Procedure, Rules 201-204, IDAPA 31.01.01.201-.204. Persons interested in submitting written NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE ORDER NO. 35309 4 comments must do so within 21 days of the service date upon this Order. The Company must file any reply comments within 28 days of the service date of this Order. IT IS FURTHER ORDERED that the proposed effective date for the Company’s proposed increase Substation Allowance is suspended until March 15, 2021, pursuant to Idaho Code § 61-622(4), unless the Commission issues an earlier order accepting, rejecting, or modifying the Application. IT IS FURTHER ORDERED that parties should continue to comply with Order No. 35058, issued June 3, 2021. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02.
