HomeMy WebLinkAbout20220830Decision Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER CHATBURN COMMISSIONER HAMMOND COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: RILEY NEWTON DEPUTY ATTORNEY GENERAL DATE: AUGUST 30, 2022 SUBJECT: IN THE MATTER OF THE APPLICATION OF IDAHO POWER COMPANY FOR AUTHORITY TO ESTABLISH A NEW SCHEDULE TO SERVE SPECULATIVE HIGH-DENSITY LOAD CUSTOMERS; CASE NO. IPC-E-21-37. On November 4, 2021, Idaho Power Company (“Company”) applied to the Commission for authority to establish a new schedule to serve speculative high-density customers, specifically, large-scale cryptocurrency mining operators. On December 1, 2021, the Commission issued Notice of the Company’s Application and Notice of an Intervention Deadline. See Order No. 35241. The Commission granted intervention into this case to the Industrial Customers of Idaho Power, and 2140 Labs LLC. See Order No. 35276. On June 15, 2022, the Commission issued Order No. 35428 therein approving the Company’s Application. On July 6, 2022, GeoBitmine, LLC (“GeoBitmine”) filed a petition requesting the Commission reconsider its findings in Order No. 35428 and grant it intervention. On August 3, 2022, the Commission issued Order No. 35488 therein granting GeoBitmine’s petition to reconsider and directing the Company and Commission Staff (“Staff”) to file comments regarding the issues raised in GeoBitmine’s petition by August 24, 2022. The Commission gave GeoBitmine until August 31, 2022, to file a reply. Staff and the Company filed comments on August 24, 2022. On August 26, 2022, GeoBitmine filed a Motion for Extension of Time to File Reply Comments (“Motion”) therein requesting an additional six days from August 31, 2022, to file reply DECISION MEMORANDUM 2 comments (September 6, 2022). Counsel for GeoBitmine explained that he had been consumed by other prior cases with pressing deadlines making him unavailable to devise “thoughtful and thorough Reply Comments.” Motion at 1. Counsel represented that the Company and Staff had no objection to the granting of the Motion. STAFF RECOMMENDATION Staff does not object to giving GeoBitmine additional time to file reply comments.
