IPC-E-21-32 NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 35214 On October 1, 2021, Idaho Power Company ("Company") applied to the Commission for an order authorizing it to: (1) modify its demand response (“DR”) programs; (2) implement associated revised tariff schedules; and (3) establish a revised cost-effectiveness method to evaluate DR. Application at 1. The Company seeks a June 15, 2022, effective date and requests the Commission issue an order by February 15, 2022. Id. at 19. Idaho Irrigation Pumpers Association, Inc. intervened in this case. See Order No. 35207. The Commission now issues this Notice of Application and establishes a deadline for interested persons to intervene. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Company offers three DR programs “designed to be available to meet potential peak-hour system capacity deficits that typically occur during low-hydro generation and high-load events on [the Company’s] system.” Id. at 2. These DR programs are the residential Air Conditioner Cool Credit Program, the Commercial & Industrial Flex Peak Program, and the Irrigation Peak Rewards Program. Id. at 2-3. YOU ARE FURTHER NOTIFIED that, in 2013, the Company and stakeholders entered into a settlement agreement (“Settlement”) which included “several program specific requirements, including marketing limitations, the method for determining cost effectiveness, and the Term of the Stipulation . . . .” Id. at 4 (citing Order No. 32923). YOU ARE FURTHER NOTIFIED that in evaluating its existing DR programs, the Company determined that the existing DR programs are ineffective in meeting system needs over the 20-year planning horizon. NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 35214 2 YOU ARE FURTHER NOTIFIED that the Company asserted that it “has experienced a change in system need and operations since the [Settlement] was approved in 2013 and requests approval to modify the DR programs.” Id. at 5. YOU ARE FURTHER NOTIFIED that the Company requests to extend the DR program season one month, shift the available event times by two hours, and increase the weekly hours DR programs are currently available, from 15 hours to 16 hours. Id. at 10. YOU ARE FURTHER NOTIFIED that to implement its proposed changes to the DR programs, the Company proposes to revise the tariffs for the Irrigation Peak Rewards, Residential Air Condition Cycling Program, and Flex Peak Program (Schedules 23, 81, and 82 respectively). Id. at 16; See Attachment 1. YOU ARE FURTHER NOTIFIED that the Company seeks to modify its current method for determining the cost-effectiveness of the DR programs at both the individual program and portfolio levels. Id. at 17-18. YOU ARE FURTHER NOTIFIED that the proposed modifications to the DR programs, along with the revised tariff schedules and revised cost-effectiveness method, are detailed in the Application and accompanying documents. YOU ARE FURTHER NOTIFIED that the Company’s Application, pre-filed direct testimony, and proposed tariff sheets are available for public inspection during regular business hours at the Commission’s office. The Application is also available on the Commission’s web site at www.puc.idaho.gov. Click on the “ELECTRIC” tab in the left-hand column of the home page, then select “Open Cases” and then locate and click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code. The Commission may enter any final order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted under the Commission’s Rules of Procedure, IDAPA 31.01.01.000, et seq. NOTICE OF INTERVENTION DEADLINE YOU ARE FURTHER NOTIFIED that people desiring to intervene in this matter to obtain parties’ rights of participation must file a Petition to Intervene with the Commission NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 35214 3 pursuant to this Commission’s Rules of Procedure 72 and 73, IDAPA 31.01.01.072 and .073. Persons who wish to intervene as a party must file a Petition to Intervene no later than twenty-one (21) days from the service date of this Order. Persons desiring to present their views without parties’ rights of participation do not have to intervene and may present their comments without prior notification to the Commission or the parties. YOU ARE FURTHER NOTIFIED that the Commission Secretary shall issue a Notice of Parties after the deadline for intervention has passed. The Notice of Parties shall assign exhibit numbers to each party in this proceeding. YOU ARE FURTHER NOTIFIED that once the Notice of Parties is issued, Commission Staff will informally confer with the parties to discuss a schedule to process this case and other issues as may be raised by the parties. IT IS FURTHER ORDERED that parties should continue to comply with Order No. 35058, issued June 3, 2021. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between parties should also be accomplished electronically. Voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
