HomeMy WebLinkAbout19930712.docx MINUTES OF DECISION MEETING JULY 12, 1993 - 1:30 p.m. In attendance were: Commissioners Marsha H. Smith, Joe Miller and Ralph Nelson and staff members Mike Gilmore, Lori Mann, Tonya Clark, Bev Barker and Myrna Walters. Items from the July 12, 1993 Agenda were discussed and acted upon as follows. 1.  Regulated Carrier Division Agenda dated July 12, 1993. Commissioners Nelson asked about Wrightway, Inc.  Do they have more than one piece of equipment? Response was:  Three power units and 2 trailers - cargo tanks. Commissioner Nelson questioned general commidities. Application was filed June 22. Commissioner Nelson said he wants him to amend his application to haul what he can handle. Commissioner Miller asked if the new motor carrier rules were in effect for this application? They are not. **Authorize temporary to haul what his petitioner hauled and make him be more specific on the other. **Authorize temporary for what original a permittee had but on permanent, has to designate from existing categories. 2.  Mike Gilmore's July 9, 1993 Decision Memorandum re:  Application of Clearwater Trucking Company, Inc. dba Clearwater Trucking, PO Box 87, Salt Lake City, Utah, for Motor Common Carrier Authority - Case No. 7789-4. Commissioner Miller said he would follow staff recommendation to have a hearing and extend the temporary until then. Mike Gilmore asked about a Commissioner handling the hearing or a hearing examiner? **Commissioner Miller will chair. **Randy Lobb was in attendance at this time. -2- 3.  Scott Woodbury's July 9, 1993 Decision Memorandum re:  Case No. IPC-E-93-15.  Firm Energy Sales Agreement Magic Valley Cogeneration Project Rupert, Idaho. Approved - was just a contract application.  K Factor suspension also looked okay. Commissioner Miller asked - what is the usefulness of the K factor?  It forces the parties to work their way through fuel security issues?  If you are only getting contracts with waiver of the factor, maybe that is okay but maybe it means the factor is unreasonable as originally intended.  Said that was just a discussion topic to review when we redo. 4.  Randy Lobb's June 30, 1993 Decision Memorandum re:  Staff Investigation of Hayden Pines Tariff Advice 93-2:  Special Facilities Charges. Commissioner Smith said her thought was we didn't want to do it as a generic thing but every company is entitled to individual treatment. Randy Lobb said he agreed but there may be some other companies that have some ideas on how you might handle this or what their concerns might be.  Don't know about doing this in a tariff.  Wanted to see if there was feed back from other companies before approval.  Would like to see if DEQ will comment. Commissioner Smith asked if the tariff should be suspended and put on modified? Randy Lobb said he thought it should be made a formal application. **Decision was to assign a case number and try to get comments. 5.  Terri Carlock's July 8, 1993 Decision Memorandum re:  Idaho Power Company Request for Authority to Issue Common Stock Pursuant to its Dividend Reinvestment and Stock Purchase Plan; IPC-E-93-13.
