IPC-E-21-21 NOTICE OF SCHEDULING NOTICE OF MODIFIED PROCEDURE NOTICE OF VIRTUAL PUBLIC WORKSHOPS NOTICE OF TELEPHONIC PUBLIC HEARING ORDER NO. 35193 On June 28, 2021, Idaho Power Company (“Company”) applied to the Idaho Public Utilities Commission (“Commission”) to initiate the multi-phase process for a comprehensive study of the costs and benefits of on-site generation as directed in order No. 34046.1 Application at 1. The Company indicated its preference that a final order be issued in this case by year-end 2021 so that 2021 data can be used to complete the “study design” phase in the first half of 2022 and the “study review” phase can be initiated in June 2022. Id. at 10. On July 27, 2021, in Order No. 35121 the Commission issued a Notice of Application and set a deadline for intervention and deadline for the Company, Commission Staff (“Staff”), and intervening parties (“Intervenors”)2 to confer before September 1, 2021, regarding a proposed schedule for this matter. NOTICE OF SCHEDULING NOTICE OF MODIFIED PROCEDURE NOTICE OF VIRTUAL PUBLIC WORKSHOP NOTICE OF TELEPHONIC PUBLIC HEARING ORDER NO. 35193 2 met and conferred regarding a proposed schedule for this matter including discussions to prepare a framework to study the costs, benefits, and compensation of net excess energy associated with customer on-site generation (“Study Framework”3). On September 8, 2021, the Commission issued a Notice of Parties. On September 22, 2021, the Commission issued Order No. 35176 requiring all Parties and the public to file initial comments about the appropriate scope of the Study Framework by October 13, 2021. Also on September 22, 2021, the Parties met and continued the work started on August 30, 2021, to develop the Study Framework and discuss a general schedule for this case. The Commission now sets comment deadlines and provides notice of virtual public workshops and a telephonic public hearing. NOTICE OF SCHEDULING YOU ARE HEREBY NOTIFIED that the Parties have proposed, and the Commission adopts the following procedural schedule: - Virtual Public Workshop #1 to be conducted by the Company on October 20, 2021, at 6 p.m. (MOUNTAIN TIME) - Virtual Public Workshop #2 to be conducted by Staff on October 26, 2021, at 6 p.m. (MOUNTAIN TIME) - Telephonic Public Hearing to be held on October 28, 2021, at 6 p.m. (MOUNTAIN TIME) - Final Comments filed by the Parties by November 16, 2021 - All Party reply comments due by November 30, 2021 - Final comments by other persons also due by November 30, 2021 NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has preliminarily determined that the public interest may not require a formal hearing in this matter, and it will review the case through written submissions under the Commission’s Rules of Modified Procedure Rules 201 through 204 of the Idaho Public Utilities Commission’s Rules of Procedure, IDAPA 31.01.01.201- 3 Instead of using the term “Framework to Study”, the Commission is using the term “Study Framework” going forward. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. Persons who would like a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that the Parties shall have until November 16, 2021, to file final written comments. YOU ARE FURTHER NOTIFIED that the Parties shall have until November 30, 2021, to file final written reply comments. YOU ARE FURTHER NOTIFIED that other persons shall have until November 30, 2021, to file final written comments. YOU ARE FURTHER NOTIFIED that comments by Parties and other persons must be filed through the Commission’s website or by e-mail unless computer access is unavailable.
