HomeMy WebLinkAbout20210922Notice_of_Initial_Comment_Deadline_Order_No_35176.pdfNOTICE OF INITIAL COMMENT DEADLINE ORDER NO. 35176 1 Office of the Secretary Service Date September 22, 2021 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On June 28, 2021, Idaho Power Company (“Company”) applied to the Commission to begin a multi-phase process for a comprehensive cost and benefit study of on-site generation as directed in Order No. 34046.1 The Company requests that a final order be issued in this case by the end of 2021 so that 2021 data can be used for the “study design” phase in the first half of 2022 and the “study review” phase can be begin in June 2022. The Company requests its Application be processed by Modified Procedure. On July 27, 2021, the Commission issued a Notice of Application and set a deadline for intervention and deadline for the Company, Commission Staff, and intervening parties to confer regarding a proposed schedule for this matter. Industrial Customers of Idaho Power, IdaHydro, Idaho Conservation League, Idaho Clean Energy Association, Clean Energy Opportunities for Idaho, Idaho Solar Owners Network, Micron Technology, Inc., City of Boise, Kiki Leslie A. Tidwell, pro se, Idaho Irrigation Pumpers Association, Inc., Richard E. Kluckhohn, pro se and Wesley A. Kluckhohn, pro se, ABC Power Company, LLC, Comet Energy, LLC, and Idahome Solar petitioned for and were granted intervention (“Intervenors”; collectively with the Company and Commission Staff “the Parties”). IPC-E-21-21 NOTICE OF INITIAL COMMENT DEADLINE ORDER NO. 35176 NOTICE OF INITIAL COMMENT DEADLINE ORDER NO. 35176 2 NOTICE OF INITIAL COMMENT DEADLINE YOU ARE HEREBY NOTIFIED that the Commission has jurisdiction over this matter under Title 61 of the Idaho Code. The Commission is empowered to investigate rates, charges, rules, regulations, practices, and contracts of public utilities and to determine whether they are just, reasonable, preferential, discriminatory, or in violation of any provision of law, and to fix the same by order. Idaho Code §§ 61-502 and 61-503; IDAPA 31.01.01.000 et seq. YOU ARE FURTHER NOTIFIED that the Parties determined an initial comment period would be beneficial to identify the appropriate scope of the on-site generation study. Consequently, the Parties, and any persons desiring to state a position on this matter, shall have until October 13, 2021, to file written comments on the preliminary issue of scope for the on- site generation study. YOU ARE FURTHER NOTIFIED that comments by Parties and other persons must be filed through the Commission website or by e-mail unless computer access is unavailable. To comment electronically, please access the Commission’s home page at www.puc.idaho.gov. Click the “Case Comment Form” and complete the form using the case number as it appears on the front of this document. To file by e-mail, the customer must e-mail the comments to the Commission Secretary at the e-mail address listed below. In addition to submitting the comments to the Commission Secretary, the Parties and other persons must also e-mail the Parties at the e-mail addresses listed in the Notice of Parties. Written comments received within the time limit set will be considered by the Commission and, in its discretion, the Commission may set the same for a hearing in the manner determined by the Commission. YOU ARE FURTHER NOTIFIED that, although the Company requested that its Application be processed by Modified Procedure, the Parties have not yet agreed to how the case should proceed beyond this initial comment deadline. The Commission will determine a schedule and format for the remainder of the case when a proposal is presented for consideration. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code. The Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. O R D E R IT IS HEREBY ORDERED that Parties and other persons interested in submitting initial written comments regarding the scope of the on-site generation study must do so no later than October 13, 2021. IT IS FURTHER ORDERED that parties should continue to comply with Order No. 35058, issued June 3, 2021. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between parties should also be accomplished electronically.
